NVC Civil Documents Include with I-864 submission?

I was looking at the steps for NVC. I know it says I need to finish DS-260 first, but do I need to submit my Civil Documents (Marriage Certificate, Police Check) with my I-864 where it says Affidavit of Support Documents & Financial Evidence (Incomplete)? Or is the Civil Documents submission a different section than the I-864?

 

I have another question. How can I (Petitioner) upload a birth certificate if I don't have it because I was not born in the United States and I don't know how to get one from the country I was born in? Or is it just my wife who needs to submit her birth certificate?

Timeline

- Civil documents is a different section

- The birth certificate is for the beneficiary

- Same for the police record, it's the one of your wife which needs to be uploaded

 

Basically at NVC stage it's all about the applicant (the beneficiary is applying to enter the US at the NVC stage and therefore is now the applicant - other than at the USCIS stage). Only the I-864 (AoS) is about the petitioner.

With the I-864. I will upload:

2022 Taxes.

 

In the section where it says other documents. I will upload

1) Evidence of income (section).

  • Work contract with a statement on why I don't have a W2/1099.

 

2) Proof of Assets (section)

  • Bank statements on how much we have in the bank. Way over the poverty guidelines.

 

3) Proof of domicile

  • Bank statements with US mailing address
  • Credit card statements with US mailing address
  • Explain why my wife and I want to domicile in the United states (work and etc.) with my signature.

Joint sponsors need other documents, but not the ones you ask about.

 

Are you "employed" or "self employed"?  WHY don't you have a W2?

I'm employed to a foreign company in the country I'm residing. I pay local taxes here and every year I submit my US taxes (1040, Schedule 1, and From 2555). They have never gave me a W2/1099. So if I'm right, If I don't have W2/1099 to submit, I just submit my 2022 taxes and a statement/letter that I don't have a W2/1099?

That's correct.  Are you qualifying based a company transfer, or on liquid assets?

Liquid assets. With that, I put the dollar amount in Part 1, number 1 and number 6. Is it okay to leave number 2, 3, 7, and 8 (where it ask for cash value, stocks, bonds, and certificate of deposits) blank or should I hand-write "NONE"?

Blank is fine.  Be sure to document your liquid assets.  I suggest a statement from a year ago, a recent one, and a couple in between.

Do you know if my wife needs a police certificate if she used to live in another country for less than 12 months. I believe she lived there for 10-11 months? I'm planning to write a letter that she was there for less than 12 months and that she doesn't need a police certificate from that country. I've read some people got RFE's because of this and some people said they wrote a letter just encase the NVC asked for a police certificate.

I wrote a letter like in the bottom. Would this work?

 

Dear Sir/Madam, 

 

I currently live and work in (Foreign Country). I am writing this letter because I do not have any W2s and/or 1099s for the years that I have been employed in (Foreign Country) since 2018 and every job that I had was with a foreign entity. Additionally, I was never paid in USD.
