Hello, I have a short notice job relocation offer with a letter and contract. But if I use this letter for my spouse's DCF visa process, am I bound to the job? If I decide to take a different offer, could I have problems? I'm assuming they just use the letter to decide if we qualify for DCF and then it's irrelevant, but I want to be sure.

Personally I think you would need to have an agreement for taking the position to proceed with a DCF.  Just having an offer that you may or may not accept I think would result in the consulate not accepting your DCF/I130 application.  Have you contacted the consulate yet to see if they will allow it based solely on an offer that you have not accepted yet?

They've already drawn me up the contract and all that is left for me to sign it and send it back to them. I thought that that might be enough, but I can try to contact the consulate.

Why not wait till you get the job you know you want before starting this process? Seems a bit deceitful as it seems you already know you are not 100 percent sure about taking the job

In order to do the DCF process, the first step is to contact the consulate requesting they accept the I130 filing directly based on exceptional circumstances.

Short answer...NO, your not! However, you do have to prove that you have and will continue to have the income necessary to sponsor your spouse. Without solid proof of income y'all will have a tough time getting approved. As for the job thing, folks switch companies all the time for a multitude of reasons like higher pay / higher salary offer. It's normal!

10/19/22 : Approval for DCF granted

10/28/22 : I-130 petition sent to consulate

10/31/22 : Consulate received I-130 petition

11/16/22 : I-130 petition approved. Packet 3 received

11/18/22 : Packet 3 sent via email

11/21/22 : Packet 3 accepted / Request for interview Approved

11/22/22: Interview scheduled for Dec. 

12/12/22: Medical completed

12/27/22: Visa Interview / 221g issued

1/18/23: Consulate received requested document

1/25/23: CAEC status changed from refuse to issued

1/27/23: Passport picked up

2/5/23: Paid immigration fee (OS155A)

6/7/23: Arrived in U.S.A

6/20/23: SS card delivered via USPS

7/20/23: GC being Produced
