Applying for Husband's US Citizenship (Still Waiting for ROC Approval)

"Filing the Form N-400 provides an automatic extension of your form I-551, Permanent Resident Card (also known as a Green Card). This notice presented along with your expired Permanent Resident Card, is evidence of your lawful permanent resident status for 24 months from the "Card Expires" date indicated on your Permanent Resident card."

So based on the verbiage above from your NOA1 you received on your N-400, it seems that it's not an extension because it's 24 months from the Green Card expire date which is the same 24 months given from Card expiration when we got the NOA1 for his I-751. His GC expired 6/18/21 so 24 months from that date on his GC is 6/18/23.

 

So it's sounding like I'm gonna need to have USCIS send me another extension which is the 48 month one that others have mentioned. 

 

 

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

Because the people who say you don’t filed  naturalize before the policy was changed.  But the policy was changed.

I don’t know why people are saying this isn’t policy.  OP will get an extension. If N-400 is filed, then because   OP has a pending I-751 this extension is useless.

Not required.  I'm not even sure it helped.  I just know we had a combo interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

N-400 extension for recent filers is only for 24 months after the green card expiration date.  OP already has this with the I-751 filed and a 24 month extension letter.  Best path forward is to file an N-400 and see if that helps move the I-751 along, and contact USCIS to try to get the "promised" 48-month extension letter for the I-751.  If that doesn't work (and others who have tried have not been successful), then try to set an appointment with USCIS for a local office ADIT stamp in the passport.  I have not seen one VJ post on someone with a pending I-751 who has received the 48-month extension letter yet, they seem to be very slow on following up on their own "policies."  My husband is still waiting for it.

I just verified that my wife did not receive a new extension letter when we filed her N-400 (Aug 7, 2022). A 24-month extension would have been useless, anyway.  Her Green Card expired in June of 2019.

I'll just get hounding USCIS for the "promised" 48 month extension ASAP. But his N-400 will be filed tomorrow, no later than Friday so we can start the end of this immigration journey!

Just adding that my husband's NOA for the N-400 did include the language regarding the 24 month extension for the green card but it is the same extension as the I-751 NOA so does not lengthen the period beyond 24 months after green card expiration. Essentially, it just becomes a "back up" extension letter that will expire at the same time as the first one from the I-751.

This is exactly what I thought that's why asked about the wording of the letter.

I can see it's being useful for somebody who has expiring 10 year GC and applied for naturalization. Otherwise, not so useful.

Exactly.  This is just another USCIS inefficiency that we have to pay for.

Trust me I plan on calling them about this but I figured I would come here to get the information quicker lol.

No he will not receive an extension letter for filing the N-400. The N-400 does NOT come with an extension letter unless something has changed in the last few months or so.

USCIS does however send out a 48 month extension letter for the i-751 these days, some will get it automatically, while others may have to request it and may be lucky to actually receive it. This extension letter has nothing to do with the N-400.

Same, no extension with the N-400 - but I didn't need one as I already had my 10 year greencard on hand. That said, if there was an extension likely they would send the exact same letter to everyone, not just those whose greencard had expired or was about to expire soon. No such letter was sent to me at any point. Must be a very new thing.

Yeah makes sense that it's a very new thing, since most of us didn't get any extension, and that was obviously pre December. Thanks for the info, I learned something new.
