I hope that's the case. But it would be better if you talk to a lawyer. Post a free question here https://www.avvo.com. According to what I know once  you are married, I-129F is invalid from that day on.. Also, I-129F approval are good for only four months. I am suspecting in my case, they denied it because it expires. That's what most of the people I know are getting it in the mail as a reason..  Wish you all the best. I hope it goes smoothly for you this time around. For me, even 5 months wait is too long. hahaha..

The 129F will be left to expire

 

I do not know your case, do not know why it was returned. So just commenting on the Misrep aspect, and yes a waiver could apply to a K1 as well as a IR1
