There have been many times when it did. You can search the forum, I have read several threads about that

Did they review it. Im in the same situation and sent a email asking for the to review it again before resending it back to USCIS?

Yup, they did. It says returned to NVC. I have already filed Cr1 now. Waiting time reset to zero after 20 months of waiting for k1 visa interview and getting punched right on the face..

my case still says refused, since March 1st. And received the email last Thursday. Yes that's the worst part the time lost I try to be positive but at times it gets the best of me.

What was your embassy? What type of email did you get? I lost almost 20 months. I-130 is now almost has 14 months waiting period. That does not include the time wasted at NVC and embassy..

Dominican Republic, and the email was an attachment with the letter saying "

Return of Petition to USCIS - Fraud. Based on information that outition approval was obtained by fraud.

misrepresentation, or other unlawtul means, we are returning the petition to USCIS for review and possible revocation. If

USCIs determines that the information presented is sufficient to revoke trie petition, you will be sent a notice of intent to

revoke that includes a statement of the facts and evidence. You will have the oportunity to respond to USCIS" which is so upsetting because I have no clue what we did wrong, we both went to interview. I lost about that same amount of time on nothing. Now looking for a solution

I didn't get the detailed of why they have rejected. As a matter of a fact, when my fiance asked him please give me a reason why you are rejecting, he said, sorry I can't give you the reason. Go ahead and reapply for a different category. However, I spoke to the lawyer and she said, the best course of action here is to get married and reapply. I will suggest the same to you. Most likely you will never hear back from USCIS.

Yes unfortunately that's what I will do, but so annoyed at this process, Ceac has not been updated since March 1st and they still have his passport

Yup, terrible. Other countries, usually process visas within couple months to reunite people. Here things are totally different. Not sure what are they thinking.. Fiance visa supposed to be done quickly but its taking months and months..

5 months for a I 130 would be very optimistic, you can see peoples processing times on here, obviously looking forward will always be a bit of a guess.

 

Misrepresentation is assessed by the Consulate, it is waiverable and if the Consulate refuses the visa there would be the opportunity of filing an I 601.

I have been reading about misrepresentation, and on the paper given would had stated if we needed a waiver, I assume that USCIS will have to make that decision correct? I am planning to file spouse visa and if we receive the NOIR from USCIS from my i 129 provide all the evidence to avoid to have to file 1 601 later on. After that is resolved withdrawal the i129
