Moving from E2 Investment to Different Business

Hi all!

 

We have a potentially tricky visa situation ahead of us and could do with some (any!) advice. 

 

My husband is currently on an E2 as he's an investor in a US business. He may have an opportunity to work for another US-based, multi-national company as an employee (he previously worked for this company in the US on an L1). 

 

He is a UK citizen, and we reside in the US. What is the best visa path that would allow him to leave the business he invested in and return to a company as an employee? Ideally, we don't want to leave the US to do this.

 

We'd be very grateful for any guidance!

Timeline

EB1 probably, but something he really needs to discuss with his prospective Employer and their Legal Team, it is up to them in the end what they sponsor him for.
