Choice of consulate to request for processing of Spousal Visa?

Hello

I am (Indian Citizen and a Canadian Permanent Resident) married to a (US Citizen) who has sponsored me for a US Green Card. We applied in March 2022 when I was living in Canada and indicated consular processing in Montreal.

Since December 2022, I been living in India, spending time with family, working on a technology startup and visiting my spouse in the US for a month at a time as a visitor. I still hold my Canadian Permanent Residency.

Can I continue with Montreal for consular processing or am I required to change it to Mumbai in India?

Thanks

You could do either

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

It would all depend on your current address.

Good answer.  Because you initially lived in Canada when the petition was filed, Montreal will be the automatic assignment by NVC.  You can change to Mumbai if you request it.

Have u maintained the Canadian address of record ?   like still pay rent or have a lease?

do intend to return to Canada?

None of that actually matters.  He still has status as a Canadian Resident and the case will be automatically assigned to Montreal.

When the petition is approved and moves to NVC it will be scheduled for Montreal.
MTL will generally ask for proof of residency, so make sure to upload proof of permanent resident status when you submit your documentation.
I suggest you follow the Canada forum for any potential issues you might encounter when submitting documents.

Thank you all for all inputs. ROK2USA, I am on that forum, and it has been really helpful in addressing some of my questions. I will be sure to follow it.

It looks like I will have to supply proof of my status in Canada to be eligible to interview in Montreal, and it looks like I should be able to meet those requirements.
