US Embassy Won't Give me My Passport Back (it's been 10months NOW)) (Merged Follow up)

Ok your case is still under administrative processing,your visa isn’t denied yet.

That longer refused text usually means you’re still in 221g AP (background checks, etc;) 

 

Final denials have a different text, much shorter. 

 

Try the IVDV email - you may get someone over there to forward it to the right person.

If the I-129F was sent back to USCIS, then your K1 case is dead.  How do you know your case was sent back to USCIS?

 

Are you still together with your fiancee?  If so, what is she doing to help get your passport from the consulate?  I thought you hired a lawyer.  What is your lawyer doing to help with your case?

yes me and my fiance are still together and we are trying to get ahold of the embassy no luck. and yes we hired a lawyer but completely useless it was a rip off. they don't even to email them or inquire. 

 

PS: The embassy said they sent our case back to uscis in september but they lied!! as you can see they sent it back in december.

also they lied to my fiance saying that they contacted me, THEY DIDN'T ON ANY WAY SHAPE OR FORM!!

We haven't heard from them ever since. no news on passport or anything else.

 

when I track my case mumber in the uscis site it says this: 

On December 30, 2022, the Department of State sent us your case, Receipt Number XXXXXX, for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

 

 

In the CEAC WEBSITE it says This:

BIG BUT  USCIS does not have control so not sure why it would say they returned the case

REFUSED does not mean refused / it means the case is going thru additional security checks 

 

only the word denied on CEAC site means "u will not get K1 visa"

so,  its not denied and not approved at this point/case is in limbo

 

And with the earthquake and possibility of more strong aftershocks,  US is warning us to not travel to Turkey plus the major airline,  Turkish Airlines,  still cancels many flights  AND  USC needs E visa to travel there and in lieu of earthquakes they may not issue this visa

So ,  did u follow CO instructions given at the interview/  CEAC should say denied if it is denied 

Refused is what all cases say while in AP

 

and read the sentence "if you were informed by the consular officer that your case was refused for administrative processing,  your case will remain refused while undergoing such processing."

 

If truly sent back to be denied ,  get married but first ,  the Algerian,  knows what was said in interview and what went wrong,  so whatever issues the CO brought up need  to addressed by a new petition/  example only:   if the 2 of u spent only little time together,   the new petition should reflect quality time .

 

As for sending it back to US office and embassy says sent back in September ,  it would have gone in that month to DOS (NVC) and then onto the office handling the case and yeah,  take till December for the US office to get and put the info into the computer / its not an instant thing for this process

 

But many of us in high fraud countries are denied a K1  (we were too)   so pull it together,   get married ,   spend real quality time together and apply for CR1

took us 6 years from 2009 to 2015 to have a IR1 approved 

 

Read the I 130 instructions carefully 

know what is expected of the 2 of u to prove a real relationship

know the income required to fullfil that part (125% of poverty guidelines)

Get ready for a long haul to get thru to the spouse interview (be ready for 2 years from marriage to process all steps)

make sure the Algerian family especially the mother approves

read the following attorney site that tells u "RED FLAG ISSUES"  as u must overcome any of these if they exist

the co didn't give me any instructions, he said they will contact me and I haven't heard from them ever since.

Hello Everyone when I track my case on the CEAC website I got this Today.

for those of you who are familiare with my story what does this mean? and does it mean I'm fianly going to get my passport back? 

 

You have been notified that your registration for an immigrant visa was cancelled, and any petition approved on your behalf was also cancelled. We informed you that your application might be reinstated if, within one year, you could establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control.

Since you have failed to do so, the record of your registration and any petition approved on your behalf and all supporting documents have been destroyed; any Department of Labor certification has been returned to your prospective employer.

If you are still interested in obtaining an immigrant visa, the petitioner should contact the Department of Homeland Security's (DHS) Office of U.S. Citizenship and Immigration Services (USCIS) regarding filing a new immigrant visa petition.

could be USC cancelled it as they gave up (i say that as it doesn't say expired)

 

talk to your partner 

could be u need to marry and go for the spouse visa as it would show 

 

  • more visits and time together
  • stronger ties as married
  • give the USC time to start commingling of finances 
  • correct any issues bought up by CO in the K1 interview as noted on 221g or by interview questions

No it wasn't her. can we do anything at this point? or we should forget about the k1 and pursue the cr1

Was there a reason why you just let the petition sit at the consulate?

 

You can request your passport back at any time, and you could have all during AP.

 

Now the USC can either file for a new petition, or you can marry and file for a CR-1.

I tried To get my passport back. for the past 3 months I sent a lot of emails,  phone calls. sadly no response from them.
