Request of Initial Evidence (Form I-130) for K1

Hi. I received a Request for Initial Evidence today for my Fiance Visa application (see screenshot below). Original NOA1 was from December 15. They are requesting evidence of a submitted form I-130. I don't understand how to respond. I requested petition for Fiance (checked box 4.a.). I did not request Spouse (did not check box 4.b.). I confirmed by checking my copy of the initial application. I answered no to both questions related to myself or my fiancee having children. I don't understand why they are requesting proof of submitting a form I-130. Nor do I know how to respond.

Timeline

Please confirm what form you submitted.. im assuming the I 129f .. 

 

Make sure that q 5 has NOT been filled in 

 

Send a photocopy of the first page of your I129f.. highlight 4(a).. and a simple cover letter stating

 

1. my petition is for K1 fiance

2. i checked the box for 4(a) on my I129f  petition form 

3. concurrent filing of I130 does not apply for my K1 application

Thank you for your guidance. That seems simple enough. Just so scared of sending an incorrect response since I only have one shot at this. Didn't think they could request evidence in error.

Its all you can do. .. and all you must do.  You must respond  to the RFIE… which you are doing ..  and you cant file an I130

 

The USCIS workers are people like us.. not perfect .. human..capsule of misreading just like i am.. or hitting the wrong key on the keyboard .. like I do!!

Hello, I have the same problem as yours. My NOA1:December 13th, I received an notification 8th Feb about RFIE. and yesterday I recived a letter as same as yours. If you do not mind can we be in the contact on Facebook or somewhere? We called at USCIS on the very same day when we received the letter mentionening I-130 which we did not applied for. The agent who picked up the call told me that someone will contact me within next 30 days!!! It is not acceptable, while it is their mistake!!!

Forgot to upload the photos. you can see the letter what I have received, same as yours @Rocketman50We just answer 4a. in the form.

We have the same NOA1 date. I bet the same agent was working on both our applications. Luckily someone is getting back to you. When I called USCIS yesterday and explained this, the person went silent. Then said they could not provide me any advice and that I needed to contact a professional. Pretty sure they knew they someone messed up and didn't want to say it.

I am so sorry this is happening to both of you. I’d proceed as @Lil bear advised. That’s the best course of action you have. Also, for peace of mind, send it with signature requirement so that you know it’ll arrive there. If we see more of those I-130 RFIEs popping up for submitted fiancee petitions, then it might even be a software update gone awry on USCIS’s part. Best of luck!

09/19/2021 interview scheduled - electronic notice received 

09/27/2021 hard copy interview notice received (issue date: 09/21/2021)

10/27/2021 interview (10.40am), approved

11/06/2021 oath ceremony (7.30am) 

 

I AM A U.S. CITIZEN!!!!! 

 

Passport:

11/08/2021 appointment at USPS (2.00pm)

11/16/2021 money order cashed, passport “in process” (locator 69)

12/02/2021 approved and shipped

12/04/2021 passport book delivered

12/13/2021 passport card and NC delivered

Hmm.

 

I wonder if this is the first day of work for whoever is pre-processing Dec 13 petitions.  One of the tasks is to check that all required evidence is attached and another is to run a background check of the petitioner.

 

Hopefully this mixup may lead to faster processing of your K1's.
