Came to the USA  4 months ago with spouse to visit family while the I-130 in progress. Circumstances changed and we are thinking of just adjusting status. I-130 approved a couple of months ago already and sent to NVC. Should I send the marriage documents that I sent with the I-130 again like photos, joint bills etc with the I-485? Or they will have a copy of the whole file that was sent to NVC including the bona fide document.

I have read that. My situation is that the I-130 is approved already so wonder about needing to resend the bona fide evidence again with the I-485

Your next filing must stand alone.  USCIS will retrieve the I-130, but each filing must still stand alone.

Sorry to ask. What do you mean by stand alone?

The package needs all the documents the instructions say to provide.  Get "they already have" out of your mind.

Yeah that I know. The I-485 does not ask for any bona fide marriage documents since generally for AOS both I-130 and I-485 are filed concurrently but mine is different. I do no know If I am making sense. Just looking for feedback from people who have gone through same process

Correct.  Follow the instructions.  Don't add to them.  Some other things "they already have" will be duplicated though.

You file new evidence of bonafide marriage that has become available since the date I-1-130 was filed.

You could, but nothing in the I-485 instructions asks for such evidence.  My recommendation is to take the additional evidence to the AOS interview.

While considering AOS, please note:

- You will not be able to work until you get the EAD, which takes several months

- As a resident of your state and no longer a visitor, you will need to get a state DL, which will require you to get the EAD first.

- You will not be able to travel back to CA until you get AP, which takes over 8 months

- You will not get a SSN until you get the EAD

- The AOS will take over a year to process.

Unsolicited, but it just seems silly to start changing things up when you’re already nearing the end of this long process.

I agree. But sometimes people circumstances change drastically and you have to make the hard choice.
