A little worried about ROC

Hi -

I included the following in the ROC package to USCIS:

1. Complete and signed i-751 form

2. Signed and notarized affidavit from my Aunt stating our family has been living in her house (we do not have to pay rent and there is no signed contract)

3. Signed and notarized affidavits from my mom, dad, and younger brother attesting to know us, our marriage, and that it is real.

4. All bank statements from all 3 of our joint bank accounts.

5. Photocopy of wife's current green card, front and back sides.

6. Photocopy of our son's birth certificate, front and back sides.

7. Joint tax returns with both our names for 2020 and 2021

8. I THINK I included proof of 2022 and 2023 Health Insurance plans with both our names as well as our son's name, but I may have forgotten to include it as well because my wife found the copies at home after I sent the package :/

 

Anyway....I didn't include any photos and we don't have any joint mortgages, car loans, utility bill payments with both our names, and as stated I may have forgotten to include proof of our health insurance.

 

We received the NOA1 and the check to DHS has been cashed. Is a lack of health insurance proof, photos, or those other financial things going to be a big hindrance???

I've seen people get approved with less and get RFEs with more; only time will tell.

In any event worst case scenario you'll be asked to send more evidence in which case you can send pictures and health insurance plans (and maybe things like call logs showing you call / text each other or tickets from the trips you've taken together etc.).

Agree.  I would just let it ride while continuing to collect additional evidence (which you will likely need at a later date such as N-400).

If your child is from the marriage, and there's plenty of financial traffic in your joint accounts you should be fine. But as others have noted, there's never any way of knowing with USCIS...

Prep for an RFE, hope for the best.  Package is a little lean but its enough to at least keep you in line.

 

IF an RFE arrives:

 

If you have matching drivers licenses send copies

If you’re both listed as drivers on the same car insurance policy send it

Health and dental, send proof you share a policy (you have that but still)

Hold on to your 2022 taxes, it will add another year of joint filing

Little one’s probably too young to be in school but enrollment records showing your contact names and addresses for school are a good adder. 
They compared our credit card numbers and house keys at our actual interview and that was AOS from K3 8 months after arrival. 

Our ROC package was a lot thicker.  
Photos and affidavits are pretty weak, your file is top heavy with weak evidence.  Keep gathering and cross your fingers.

I don’t know if you’ll get an RFE or not - time will tell. But what I do know is that you should have made a copy of the package you sent!

How do you send unsolicited evidence for a form that isn’t filed online?

The extension letter has a return address on the bottom of the page.

 

Send the evidence to that address.
