Affadavit I864 help - Wife lives with me in the U.K

Hi, 

 

My wife and I are applying for my green card (again) second time around, I surrendered my last one however we are going back! Last time we did the visa all with London consulate, it was far easier! 

 

The Affadavit of support - she lives with me in the UK, and does not earn in the USA or obviously live there. 

 

We are planning to use my father in law again, however we originally applied 5 years ago and I simply cannot remember... 

 

As she does not live in the USA, is he the main and only sponsor.. Or does she have to do a form as well? Do they go on the same form? Or do they do a form each?

 

He lives in the USA and earn enough.

The petitioner (your spouse) is always the primary sponsor.  The primary sponsor, as well as the joint sponsor, must complete an I-864.

Unless you have exceptional circumstances, you will not be eligible for Direct Consular Filing.

Sorry if obvious, is that two separate forms one each? Or does the joint sponsor do a separate form?

Each must complete a separate I-864.

You aren't finding this information because you aren't downloading and becoming an A-Student of the I-864 instructions.  Doing so will be critical to your ultimate success.

 

Is your Father in Law married?

I think because we have been through this all before I thought it would be simpler, but the I-864 has humbled me. 
 

Yes father in law married to my wife’s mother who is American. I have an American wife and two American children. Just as we all currently live in the U.K. (I am British) she does not have any USA income.

Yes I did. I filed it 3 years ago ish. When we came back to the U.K. we didn’t know if it was going to be for 1 year or 10 years so we’re advised to surrender it and re apply. In hindsight I wished I hadn’t!

Then the mother in law should also provide an I-864a whether she has any income or not.
