his conditional GC expired last year on 09/14/22.... we submitted 09/02/23..... we got the 48 months extension letter... when is he allowed to apply for N400? now? or SEpt?? I am confused.... we got married 09/13/2019 N400 is base on years being married to US citizen? or years being a Resident?
?

Years being a resident, so from your expiration date that would be 09/14/2020 and he's eligible 90 days from 09/14/2023.

Based on the 9/14/22 date of the GC (residence since date 9/14/2020), the earliest he can submit the N400 is June 16th, 2023.  The N400 is based on years as an LPR, not years of marriage.

Middle of June (June 16th) would be 90 days prior to his 3rd year anniversary of being a permanent resident.  If applying online, wait a few days after the 90 day window opens.

Good Luck!

I am sorry peeople saying wait dont know what they are talking about.

ROC is taking years and if u wait to apply for N400 then again you are at mercy of which field office you live in . Let says u wait and it takes 30 months to get approved and then you file N400 and your field office is say 12 months at least. so u have waited at least 4-5 years from the day u applied ROC. This will happen smoothly provided u are still married or your spouse does not die. And u have administration which is friendly. Though my opinion is No one care about legal immigration
