Form I129F Section 3 Question 4.a

I filed form I129F, but I noticed now that Section 3 Question 4.a was not selected correctly. I chose "No" but I remember a dismissed case from 1999. I was 17 at the time, but I did get finger printed during processing. The case was a misdemeanor for telephone harassment that was eventually dismissed. I had completely forgot about it since its been like 23 years. 

 

I called the local circuit court office, but I have a problem. The case deposition or case file has the wrong date of birth I was told over the phone. I won't be able to fix it when I go to pick up the certified case deposition. I was told that I would have to file a motion, and have a court hearing if I want the case file to show my correct date of birth.

 

Can I just send a letter to the USCIS field office in California with a new signed I129F form, an explanation, and the case deposition with the incorrect date of birth? I would likely need to hire a lawyer if they need the case deposition to show my correct date of birth. They could order a biometrics appointment if they need to confirm its the correct case since my finger prints would bring it up.

Maybe, but a lawyer is advised at this point in time. You may pass I-129F stage without this coming up, but eventually it might further down the road.
