The sponsor or joint sponsor (if required) on form I-864 Affidavit of Support must submit the following:

W-2s, 1099s, and/or all schedules submitted to the Internal Revenue Service -- a copy of his/her Federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal tax return.

:blink: I wish I hadn't forgotten to make a copy of the entire packet that we mailed out so I could tell you exactly what was in there. But no, I was in such a rush that I remembered the next day that duh, I forgot to copy everything we sent. Ah well, too late now.

So. They're looking for W-2s and whatnot because I submitted a copy of our tax returns. They don't specify if they want it for me or my co-sponsor (my mom) so I'm assuming we just send the W-2s and whatnot for both of us. I sent that already, but I'm guessing they just lost it. :rolleyes: I'm trying to figure out if maybe I left something out, though. If I don't give them what they're exactly looking for will they just RFE us again, or will they deny his application? Should I include a copy of the entire tax return with it? I'm wondering if maybe I missed a page in the tax returns or something. For the W-2s, do I have to send originals? I assumed I could send copies.

I'm not complaining as I know it could be worse, thank goodness they didn't lose his medical or anything. I'm just surprised there was nothing in his online case status saying they sent a RFE.

copies of the W-2 are fine. :thumbs: hopefully this will not cause too much delay for the interview schedule. I think at times they are a little slow on updating online. it still says nothing about my wife's interview date.

It says to send it to a PO Box in Missouri. Is there any address that I could Fedex it to?

We made a copy of the RFE letter and returned the original. I don't think there's an address to FedEx it to, at least not that I've seen. Good luck...hope it gets resolved soon!

Hi Angilla. No, USCIS won't just deny you. You'll be given chances to submit whatever it is they're asking you to submit. Make sure you send them exactly what they ask for in the RFE. If they want W-2s, send them both yours and your co-sponsor's. They can't deny you for sending them exactly what they requested on the RFE.

I would send copies of anything requested unless they specifically ask for the originals.

Good luck. Your particular RFE doesn't sound bad at all. It's seems rather routine.

Thanks all! I just sent it out overnight by the postal service. I included copies of both entire tax returns and a cover letter saying that it includes all W-2s, 1099's, and schedules for both the sponsor and joint sponsor.

I wasn't sure if I should send them the original RFE or not so I did what Karen said, I sent the original RFE back and made a photocopy of it to keep for myself. I hope that was the right choice. :blush: They said to "include this letter" with my response... that sounds to me like they wanted the original. And there is a barcode on it so maybe that's why, maybe a copy of the barcode won't scan properly or something.

I got the same RFE.. I was so mad, as i sent everything they asked for the first time round.

When I called them to get further information, they asked me to send it all again, as it may have gone *missing* - this whole thing is getting on my nerves now, and the status online never seem to change either..

When i replied, i sent the original letter back (made a copy for my records) plus all of the tax returns etc i had sent the first time..

Now its just a waiting game..

I'm pretty mad too, that his case is delayed over something so stupid, but the way I'm looking at it is that it could be much worse. People have had their medical exam info go lost. Now THAT costs time, inconvenience, and a few hundred dollars to replace. At least this all I had to do was drive 15 minutes to my mom's house, make a copy of her (she's my joint sponsor) and my tax returns, and lose $20 to overnight it to Missouri. I can eat that. I can't eat $200. So if they had to lose something, I'm glad it was something that didn't cost me anything to replace.

But my mom's pretty upset that her tax return info with her social security number on it could just be floating around somewhere.

That's odd that the online case status never changed, though.

Yes Angilla, your assumption is correct. There is no way USCIS will catagorically deny you without giving you a chance to appeal. US law just doesn't work this way.

If they require anything more, they'll send another RFE.

USCIS can do whatever they want. Never assume they will be satisfied with the information you have sent in. Check your case status and follow up if need be. Stuff does get lost in the mail or sorting room, and sometimes (but rarely) the stuff you sent in (that seemed fine to you) isn't fine with them.

They are under no obligation to send a second RFE. So just stay on top of your case.

That is hardly the case. Some people like to paint this draconian picture of the USCIS as if all involved were devils out to screw with everyones' lives. There are rules and regulations and USCIS is absolutely constrained by what they can and cannot do. It's a categorical fact that USCIS cannot do "whatever they want". USCIS will be the first ones to say they can't do whatever they want.

I will admit rebeccajo offers some good advice about following up to make sure they received what they're requesting. Things do get lost and mis-filed from time to time, so it won't hurt to be pro-active and follow-up.
