I-601 Filing requirements and Processing Time

Hi All,

 

I filled for my parents under IR5 and I got approved from consular interview for my Dad and my mom received 212(a)(6)(c)(i) under a previous case which was filed on the wrong category of filing. So I would like to file I-601 Waiver of inadmissibility for my mom and what like to know what kind of documentation is required to support the form filling. And what is the approximate time for processing as of Feb 2023? Is there a scope to expedite the process as my Dad will be here in the states next week and my will be back in home country?

A child cannot file a waiver for a parent. A child is not a qualifying relative.  A spouse is a qualifying relative.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah my dad will be filling the waiver for my mom once he is here next week.

Reported processing time is about a year, approval rate runs 60-70%

Documentation of extreme hardship to the LPR spouse?  That’s a steep hill if he’s just arriving.  Best of luck.

Why would she get a ban for wrongful category of filing? USCIS just rejects such cases and asks you to file under correct category, not issue a ban. 

 

Something is fishy here. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Something is fishy here. 

Nothing is fishy. Its straight forward case but hard to explain that reason. Looking to file a waiver for the same
