Sponsored other person before on I 864

Timeline

Yes I did sponsor another person 18 years ago.  I have no idea if she is a lawful permanent resident or if she is an illegal as the question on Part 5 question 6 asks.  She abandoned me within a month.  i have no contact or information as to where she lives.  I am not sure how to answer because I have no knowledge of her immigration status.  Should I answer no?  thanks

If you do not know her status, definitely do not answer no.  from the i864 instructions:

  1. Your obligation to support the immigrant you are sponsoring in this Form I-864EZ will continue until the sponsored immigrant becomes a U.S. citizen, or can receive credit for 40 qualifying quarters of work in the United States. Although 40 qualifying quarters (credits) of work generally equates to 10 years of work, in certain cases, the work of a spouse or parent adds qualifying quarters toward eligibility. The Social Security Administration can provide information on how to count qualifying quarters (credits) of work. The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.

You answer yes.  You say no and you’re done.  They’ll know.

 

NOTE:  If she is still an LPR without 40 SS credits you’re still on the hook for her and she counts towards your household size.  Not likely, but you need to always submit accurate information.

did she come on K1 or spouse visa?

If  K1 she could not AOS without u

If spouse,  did u 2 divorce and did she get copy of the divorce papers so she could RoC without u

 

that's all for your info

 

but yes, u did sponsor someone and have to say Yes

I just located her for the first time in over 15 years.  I talked to her and she said she has paid social security for more than 10 years. She is a LPR. I was able to contact her through her parents.   I was going to answer yes anyway because it was automatically checked on my application. but the way it was worded I was a little confused.

Did you file I-130?

 

Did you file I-129F?

 

Why didn’t you withdraw I-864 as soon as she abandoned you?

OK that’s good.  You do answer “yes” but you do not count her towards household size in your affidavit.

Rough situation.  I empathize.  Best of luck moving forward 👍

Yes, we were married.

I thought my lawyer took care of it.  He didn't.
