Petition for Mother, Stepdad and sister (13 years old)

Good morning, I hope you are well. I am a 25-year-old U.S Citizen seeking to legalize my mother, stepdad, and minor sibling. (My mom and stepdad married when I was 11 years old). They all entered with a visitor visa. Has anybody gone through this same process?  What are the steps to take?  I would appreciate any information. Thank you so much.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They can not adjust and seems like they would be subject to a ban on leaving

 

Are there any qualifying relatives to file a waiver?

 

There is an exception if you are in the Military

I'm an IR5 parent of US

Parent of US is forgiven for any overstayed if they are adjusting status and came with a US Visa

If the overstayed is the only problem they are all set to go

Yep misread and thought they had not overstayed suitably admonished do not do this on a phone

A sibling is not an immediate Relative.

The issue will be with the minor sibling as they are not considered immediate relatives in the eyes of USCIS.

I am in a brain fog obviously my first thought is that there is time for parents to naturalise and petition sibling before 21

 

Or consulate processing as child of LPR before 18 1/2

You can petition your parents via I-130 (1 for each) and they can adjust status.  Your sibling cannot.

 

When your parents get their GC, one can go back with the minor child and the other can submit an I-130 for consular processing, category F2A.
