Do I need a co sponsor (split)

Did you have to show any assets in addition to your income (salary) from China? I am in same situation as you (all income in Canada) with no assets in US. Would you suggest getting co-sponsor who is in US?

Please be clear what you are trying to accomplish, particularly in terms of the affidavit of support.  

 

The short answer is that if you do not have US Based income and you are not transferring with the same company,  your income will be stated as zero.  If you don't have 5 times the income requirement in liquid assets, you'll need a joint sponsor.

Thank you sir. I am trying to take transfer to US within same company however it will only be possible if they have position open which fits my profile. I can get email from my manager stating that they are working on the move.

 

Do you think it's safe bet to just get co sponsor to avoid hassle at interview?

The email will be meaningless, so if you are at the NVC stage now, you'll need a joint sponsor.  If the transfer is confirmed before NVC stage, you won't.  Actual facts make a difference.

Montreal is very strict on US domicile for the USC petitioner.  To make this work, most petitioners in your situation return to the US after filing the I-130 petition, to establish a residence and start working about six months before the Canadian spouse's anticipated visa interview date.  So plan on a period of separation in order to satisfy the US domicile requirement.  Of course, you can visit her in Canada as often as your work schedule allows, during the spousal visa process.  You don't want to take a chance and add more months of waiting to a process that is already way too long.  Good luck!

I have read about Montreal being difficult on domicile stuff few years ago. In recent years some folks were able to get away with job offer and lease agreement in hand when they went for interview. 

On other hand there is chatter going on about removal of visa interviews starting April 2023 to reduce the backlog. Do you think this might help my domicile situation?

A job offer and lease agreement will be fine.  Note, that it's possible the petitioner will need to move for the job earlier than the spouse anyway.

 

The chatter is about other visas, not immigrant spouse visas.  Context is KING here.
