Delayed case passed 120 after I 485 interview

Hi -my husband and I went on our interview May 2022. After the interview the officer said that everything looked good but gave us a paper saying that she had 120 days to make a decision. This is long past. We are now enter Feb. 2023. The status of both our accounts says “interviewed scheduled”. We have already contacted our senator but they came back with “the case is progressing”. We have reached out to uscis and we keep getting the same answer. It is progressing.  I am wondering has anyone successfully sued the govt ? How long does it usually take to push things along? Any other option available?

Try USCIS ombudsman before suing. 
 

The paper from USCIS giving them 120 days was a fatal mistake on their part.
