The Right to Refuse Service: Can a business refuse service to Someone because of appearance, odor or attitude?

In the 1960's, the Unruh Civil Rights Act was interpreted to provide broad protection from arbitrary discrimination by business owners. Cases decided during that era held that business owners could not discriminate, for example, against hippies, police officers, homosexuals or Republicans, solely because of who they were.

In cases in which the patron is not a member of a federally protected class, the question generally turns on whether the business's refusal of service was arbitrary, or whether the business had a specific interest in refusing service. For example, in a recent case, a California court decided that a motorcycle club had no discrimination claim against a sports bar that had denied members admission to the bar because they refused to remove their "colors" or patches, which signified club membership. The court held that the refusal of service was not based on the club members' unconventional dress, but was to protect a legitimate business interest in preventing fights between rival club members.

On the other hand, a California court decided that a restaurant owner could not refuse to seat a gay couple in a semi-private booth where its policy was to only seat two people of the opposite sex in such booths. There was no legitimate business reason for the refusal of service, and so the discrimination was arbitrary and unlawful.

In one more complicated case, a court held that a cemetery could exclude "punk rockers" from a private funeral service. A mother requested that the funeral service for her 17-year old daughter be private and that admission to the service be limited to family and invited guests only. The cemetery failed to exclude punk rockers from the service. The punk rockers arrived in unconventional dress, wearing makeup and sporting various hair colors. One was wearing a dress decorated with live rats. Others wore leather and chains, while others were twirling baton-like weapons, drinking and using cocaine. The punk rockers made rude comments to family members and were generally disruptive of the service.

Ironically, the funeral business had attempted to rely on the Unruh Civil Rights Act, claiming that if they had denied access to the punk rockers, they would have been in violation of the Act. But the court held that the punk rockers' presence had deprived the deceased person's family of the services of the business establishment, which were meant to provide comfort to grieving family members. On that basis, the court stated that the funeral business could have legitimately denied access to the punk rockers.

1st excuse my English. Thank you.

I would like to know my rights as a legal resident there when I am married to an American Citizen.

What can I do if I will be discriminated in going inside a rich restaurant or shopping at rich stores, and they don't want me inside because of my ethnicity? One of my friends from the Philippines went inside a store, she could afford to buy the store's products but she wasn't treated well because she is Asian. I don't want that to happen to me. Can I sue them? what about if others are too harsh on me; nasty words, disrespecting me, insulting where I came from, etc.. I can excuse 1-3times I think but if I couldn't take it anymore?

Please advice. Thank you very much!

Since you decided to point with your comment that you are better than my fiancee' because she is "white", it's not my attitude that needs changing. It's not me who needs to adapt to a new environment and culture. It's you when you come here. The only person who has shown they are racist and discriminating, is YOU. You turn your nose up and make comments like that about white women when you're here in the US, and you're sure to have a white American woman knock you on your butt. American women come in other colors also. Black, brown, yellow, and red. It won't matter to them that you're darker skinned. American women won't put up with that bullshit. We are a very diverse nation of cultures from all over the world. It's my RIGHT to choose what lady of skin color I want to marry. I am not ashamed and don't deny I'm of Filipino heritage. But because I'm Filipino, that doesn't mean I have to give you any special treatment. Ethnic backgrounds or where a person comes from doesn't make any difference to me. If I don't like someone, I just don't like them. If you think that I am rude, as we say here in America, you're in for a very RUDE AWAKENING! I'm fairly tame. You're going to encounter people much worse than I could ever be in my lifetime. ;)

It makes me laugh that you wish to know your "American" rights. That's fine. Wouldn't it be smarter to be asking a qualified attorney-at-law about your exact rights? You should've done that before accepting a marriage proposal to an American man. You seem to be more focused on our streets that are paved with gold, our mansions with swimming pools, and sports cars. Don't forget to fill out Form 411 to collect your $1,000,000.00 dollars when you arrive at your Point of Entry.

You are certainly entitled to these materialistic rights as our American movies always show the world! :thumbs:

It seems I missed all the fun last night! So I got called "ugly" in Filipino? Big deal. I know I'm about as beautiful as a person can be. :D I don't hide the real person I am behind a fake photo of a magazine model. Yes, I am Filipino and proud of it. I'm American first and foremost. I was born here. I don't need to dig for gold. Whenever I choose to go to another country, acting ignorant while being arrogant, is something I don't see that will help you. Most Americans aren't going to tolerate you and you're not going to find yourself being happy here. If this is the way you're going to respond to people here in the USA, I don't think your soon-to-be husband will be getting very much attention. Buying signatured stuff doesn't mean a person is a gold digger I love Louis Viouton bags, so when I am there I plan to go shopping at their stores and not to worry about it's authenticity, ya know. So if that store wont let me in because I look asian discriminate me to shop and probably will think I cant afford to buy any of their stuff, they will let me out, so I asked what can I do, just in case? Sept.5 I am here to learn, and not expecting some rude comments.

ppl give answer/ideas/suggestions and not making fun of what I am asking, just about my question, parental guidance, thank you very much but see im an adult, lol. it's like some ppl think i am asking my rights in advance, knwoing what to do when im being discriminated at stores misinterpreted as gonna have free money,planning to go shopping to expensive stores, buying loius viouton bag makes me a gold digger?,wow.
