Shunned Women Refused Service, Sues Store

Ruth Irene Garrett, the ex-Amish woman whose fascinating book Crossing Over I reviewed a little while ago, has filed a lawsuit against an Amish thrift store for refusing to serve her. She has been excommunicated from the Amish and is shunned by the Amish community; she, however, insists that this doesn't justify ignoring anti-discrimination laws.

The Lexington Herald-Leader reports (via Internet Infidels Forum):

[W]hen Garrett was turned away from an Amish thrift store, its owner called it a case of religious freedom because taking money from the excommunicated comes with a risk of being thrown out, too, and damned to an eternity in hell. “Personally, I don’t feel like I did anything wrong,” shop owner Erma Troyer said.

The Human Rights Commission heard the case this past month and a recommendation could come early next year. In addition to unspecified damages, Garrett’s complaint seeks an order requiring Troyer to serve anyone and training to familiarize her with civil rights law.

Troyer says that serving people like Garrett would be a violation of her religion. That’s true. However, what if it were a violation of her religion to serve blacks? To serve mixed-race couples? Would it still be acceptable for her to engage in this discrimination? I don’t think so. A person’s right to practice their religion cannot extend to actions which undermine the public good, and the public good is harmed when stores that are open to the general public are able to discriminate like this.

It’s true that Garrett’s choice to leave the Amish carried consequences, including being shunned by the Amish. These consequences cannot, however, be supported by the state in the form of special exemptions from generally applicable laws. The Amish wouldn’t be exempt from laws against killing or raping ex-Amish, obviously. Why? Because such actions violate the rights of those being harmed and undermine the general public good. The same is true when it comes to the sort of discrimination described above, even if it’s not to the same extreme degree.

If the Amish are going to open stores that admit the general public, putting them into direct and regular contact with non-Amish, they have to accept the fact that they are becoming directly engaged with an outside world which does not follow their religious doctrines. This may make it difficult for them to maintain a closed enclave run by their religious doctrines. The forms of discrimination which they engage in privately, on their farms and in their private lives, can’t necessarily be accepted in public and while operating a business.

Having strong religious beliefs does not exempt one from the law.

It seems I missed all the fun last night! So I got called "ugly" in Filipino? Big deal. I know I'm about as beautiful as a person can be. :D I don't hide the real person I am behind a fake photo of a magazine model. At least, you could have chosen a 1/2 decent model of real "beauty". ;) I know who I am, what I am, and there's nothing you can do to make me feel otherwise. I will not give you approval to make me feel inferior. As I have obviously, done to you. :lol:

Yes, I am Filipino and proud of it. I'm American first and foremost. I was born here. I don't need to dig for gold. Whenever I choose to go to another country, acting ignorant while being arrogant, is something I don't see that will help you. Most Americans aren't going to tolerate you and you're not going to find yourself being happy here. If this is the way you're going to respond to people here in the USA, I don't think your soon-to-be husband will be getting very much attention. You're going to be spending most of your time filing complaints against everyone who you think is not being nice and believing they have discriminated against you. Buying signatured stuff doesn't mean a person is a gold digger I love Louis Viouton bags, so when I am there I plan to go shopping at their stores and not to worry about it's authenticity, ya know. So if that store wont let me in because I look asian discriminate me to shop and probably will think I cant afford to buy any of their stuff, they will let me out, so I asked what can I do, just in case? No, I didn't mean to say filing complaints all the time when ppl like you are rude, knowing my rights when I am there, is what I meant. Stores wont let me in for being asian which is open to public but wont let me in, can I sue them. I really don't think you have anything to be so concerned about. If something does happen, you'll do what anyone would do -- talk to the manager and if need be, contact the corporate office to discuss further. People don't normally sue for poor customer service or for being treated rudely.

I really don't think you have anything to be so concerned about. If something does happen, you'll do what anyone would do -- talk to the manager and if need be, contact the corporate office to discuss further. People don't normally sue for poor customer service or for being treated rudely.

Since you decided to point with your comment that you are better than my fiancee' because she is "white", it's not my attitude that needs changing. It's not me who needs to adapt to a new environment and culture. It's you when you come here. The only person who has shown they are racist and discriminating, is YOU. You turn your nose up and make comments like that about white women when you're here in the US, and you're sure to have a white American woman knock you on your butt. American women come in other colors also. Black, brown, yellow, and red. It won't matter to them that you're darker skinned. American women won't put up with that bullshit. We are a very diverse nation of cultures from all over the world. It's my RIGHT to choose what lady of skin color I want to marry. I am not ashamed and don't deny I'm of Filipino heritage. But because I'm Filipino, that doesn't mean I have to give you any special treatment. Ethnic backgrounds or where a person comes from doesn't make any difference to me. If I don't like someone, I just don't like them. If you think that I am rude, as we say here in America, you're in for a very RUDE AWAKENING! I'm fairly tame. You're going to encounter people much worse than I could ever be in my lifetime. ;)

It makes me laugh that you wish to know your "American" rights. That's fine. Wouldn't it be smarter to be asking a qualified attorney-at-law about your exact rights? You should've done that before accepting a marriage proposal to an American man. You seem to be more focused on our streets that are paved with gold, our mansions with swimming pools, and sports cars. Don't forget to fill out Form 411 to collect your $1,000,000.00 dollars when you arrive at your Point of Entry.

You are certainly entitled to these materialistic rights as our American movies always show the world! :thumbs:
