Interview refusal

Hi,

After over 2 years of wait i went to the interview today with my spouse and 3 years old son, the consular gave us refusal letter asking for more information and including the below:

 

-The consulate wrote a note "I-864A contract with MoH" and this is in the part of joint sponsor (Tax transcript)

-Proof of domicile.

 

I am living in Egypt since 25 years and i never visited the states since i was 8 years old.

 

The joint sponsor is my sister's spouse.

 

 

I would appreciate any advice :)

Timeline

just get a copy of joint sponsor's profile of US passport or state DL to prove his US residency and send to embassy

include your  case # and both names and DOB's on the copy page (upper right hand corner is preferred )

 

u need all pages of the IRS tax transcript

Provide what they’re asking for. They want the joint sponsor’s spouse to fill out I-864A and I believe they want domicile proof for your spouse (US citizen petitioner). They want to see proof that your spouse is intending to return to the US to live there.

I wonder do they need the joint sponsor's spouse signature alone or both signatures at the same time? And what does MoH means?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I-864A is solely for the spouse of the joint sponsor so he/she will fill it out and sign it

Let's be more specific.  A US Passport copy is evidence of US Citizenship but not evidence the person actually lives in the USA.  Driver license isn't either, really.  I have a Texas Driver license but I've lived in the Philippines 5 years.  A utility bill will do nicely for that.

 

Need an I-864a from the joint sponsor's spouse.

 

Need a Tax Return Transcript from the Joint sponsor, not just ANY tax transcript

 

The domicile issue is different.  It's for the US Citizen and it means they need evidence of intent to establish domicile in the USA.  Lots of threads and advice here about that, but it take more than just the obvious sponsorship of foreign spouse and child for visas.  I'll let others advise on that.

That isnt a refusal.  Sponsor’s spouse needs to submit an I-864A and they will complete your case.

What plans have you made to return to the US? 
have you looked for a job, have you looked for schools or housing? Have you created a US bank account? 
I might be wrong but you might have to return to the US before your spouse gets their visa to show you intend to move with them.

I did what i was able to do such as:

Openning discover bank account.

Getting discover credit card.

Transfered funds to the bank account.

Using my credit card.

Appling at university to join when i arrive.

Prepared sharing apartment contract with my sister who is living in the states.

 

The only thing I couldn't do is to travel to the states alone as i have 3 years old son which needs me around.

 

This is the exact thing the consular asked me to so but i cannot deny that i am disappointed because i tried to explain my sitution but it didn't matter anyway.

Are they looking for proof of domicile for you the petitioner or your joint sponsor? 
this poster went through something similar maybe you can get some additional ideas to show proof to establish domicile.
