Timeline

I've been reading for a while in these forum and I'm thinking about something. Upon reading most of these posts, I'm seeing over and over somethings about custody so imma go ahead and explain my situation. I'm a LPR by marriage and I have a son from a previous relationship. We were not married however in the beginning of my pregnancy,  he wanted me to do away with the child. I did not follow through with his request and now my son is 11yrs. So my son is currently in the US and doing AOS, my son and his father does not have an ongoing relationship because he grew up seeing me only since he was 3yrs old. When his father left at that time, we did not have any communication as well as he didn't visit the child nor provide for him and still isn't providing for him. Since there was no initial custody agreement between myself and his father, could this be classified as a case of abandonment and/neglect if in case immigration asks for any document pertaining full custody of the child? If yes, what can be submitted if RFE for it. His I-130 has already been approved with the evidence given by my husband from 2021. Currently awaiting further instructions for the AOS. I look forward to the responses
