1095-A & 8692 Tax for Healthcare Marketplace

Hi all,

 

hope you can give me some suggestions. I filed I485 & I130 for my mom (87) Dec 2021 and got approved few weeks ago. While she was staying with me in same household in 2022, I purchased Health insurance through Marketplace so that she is insured. She does not have any income or had her retirement from her country transferred to her in U.S. Now it seems for 2022 ,  I need to submit Tax forms 1095-A & 8692 and I wonder if I should submit it at  with my tax submissions as one house hold or should that go separate? Also we are still waiting for her SSN .

You are not filing taxes with your Mother. Taxes are filed per individual or jointly as a married couple. I suggest you talk to a qualified tax preparer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She took a tax credit from the marketplace to lower her insurance premium and now the IRS wants to see her actual income for 2022 to verify that she qualified for the credit. If not, she has to repay it.  She will have to get an ITIN and file a return as single. Her foreign retirement income is reportable as income, even though she has not transferred it to the US.
