Question about passport photo and my I-129F form data

So, the picture we used was initially a digital photo, but it was the correct square dimensions.  Instead of waiting 2+ weeks for mail, I went ahead and used it, except I did validate it on the Travel gov website, I forget exactly the URL now, but am willing to provide it if requested.  The picture wouldn't validate while it was digital, so I took it to FedEx Office and met a nice Filipina lady, which was odd because my fiancé is also Filipina.  Anyway, she printed out several 2x2 color pictures for me and cut them also.  I brought the photo home, I scanned it and the online tool validated it as being acceptable to use.  A little bit of her head is cropped out, her ears aren't showing, and the dimensions may not align with their 1-1/3 rules.  My question is really how strict are they on the passport photos?

 

I sent my only copy of my original passport photo, which I already regret.  However, I know I can just visit UPS or FedEx and get one pretty quickly.

 

Since then, I asked my fiancé to get a REAL passport style photo.  She's going to mail that and her intent to marry document signed to me, so I'll have those if/when they're RFE'd, I just sent them a picture of her intent to marry, since I didn't want to wait for snail mail.

 

Also, this is everything I put in my I-129F packet.  Does this look ok?

              Please find my enclosed form of I-129F Petition for a K-1 Visa for Kate ****** *********, evidences, and supporting documents.  I think that I should also mention that I am a holder of a federal government HSPD-12 Q security clearance, due to the nature of my job.

·       Payment in the amount of $535

·       Petitioner’s G-1145 Form

·       Petition for Alien Fiancé(e) USCIS Form I-129F Pages 1-13 Completed and Signed

·       Kate’s signed Intent to Marry Fiancé document.

·       My signed Intent to Marry Fiancé document.

·       My Itinerary from the trip to Cebu from December 8-December 29.

·       A QR Code we had to get to enter the Philippines.

·       Pictures of luggage tags

·       Lite Shipping Ferry ticket from Cebu dated Dec 10, 2022.

·       Luggage ticket, Korean Air boarding pass, same Lite Ferry ticket as above.

·       Receipt from Apple Tree Suites in Cebu City with both mine and Kate’s name on it Dec 19th, 2022.

·       4 more ferry tickets dated Dec 19, 2022.

·       Receipt at Sprinto store inside the SM Mall, with my signature, Cebu airport, and Korean Airport.

·       A portion of my Visa credit card statement with foreign charges highlighted, some belong to the receipts.

·       2 receipts for remittance in the amount of $100 and $120 to support Kate.

·       A copy of my passport, the stamps from the Philippines, and a Korean Air security sticker on the back.

·       My certificate of live birth from the State of Tennessee.

·       Kate’s certificate of live birth from Cebu City, Philippines.

Irrelevant to a Fiance Visa.   Have you considered marriage and a CR-1?

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A K-1 might be a better choice when 18-21 year old children are immigrating also
    In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice   
    A denied K-1 is sent back to USCIS to expire
    

CR-1
    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

It means you don't have a chance to rebut a denial of a K-1.

As the petitioner, they won't need your fingerprints.

Yes, it does.  The Utah Zoom marriage makes it easy to marry from anywhere in the world.

NOTHING is fast in immigration....and certainly not super fast.  Both the K-1 and CR-1 will take about 18-24 months from filing to visa in hand.

FYI-  According to other VJ members the average K-1 visa is currently taking about 573 days from filing to interview.  Good luck on your journey.  Visa Journey is a great place.

Your security clearance is not relevant.  If anything, it may take longer for them to verify it and dig into your past.

 

Her birth certificate is not needed.  The more non-relevant items you add, there is a chance things will take longer.  USCIS likes to investigate submittals to see if there's conflicting information.

 

Immigration timelines are cyclical.  20 years ago it could have taken 2 years, 10 years ago it could have taken 5 months.  Current timelines are 18-24 months.  The trend in the last 6 months shows increased processing times.

Just another perspective then... Me and my fiancé were never married before, no kids, in our late 20s, less than a month in age difference, plenty of evidence of bona fide relationship, talked for years before getting engaged, both have a stable job and good income, never had any problems with the law or immigration... And it's been 340 days already for the I-129f petition to even be touched and I don't expect to be there and marry him at least until Fall this year (or even Winter!).

It's a hard lesson to learn, but listen to the most experienced members here... nothing in immigration is easy and quick. I got tired of shutting down relatives and friends researching options and "loopholes" when in fact they do not exist or are blatantly illegal. When I got into this process, I was waiting for 6-8 months for the petition, now it's 15.5 months and you just gotta keep going and manage your expectations. I believe that if two people really love each other, they will withstand everything together. This process as it is right now takes the commitment to each other to a whole other level.

No, not for an RFE.  You would have to pay if you refile after a denial.
