N400 based on 5 years rule

N400 

Hi I have a question about filling N400 based on being 5 years permanent resident. I filled the application online and I was asked to submit marriage certificate and divorce certificate.  My application is not based on marriage any more it is based on being card holder for more than 5 years.What additional documents should I submit? Thank you all in advance

Timeline

If you are asked to submit a marriage document and a divorce certificate, do so.

 

In general, you want to give them any documents they specifically ask for.

 

No, you're not filing based on your marriage.  But they can still ask you for the certificates.

Timeline

I attended my interview and 10 days ago I uploaded IRS tax returns on the site as unsolicited evidence.

 

The officer didnt ask for any and I did tell him I have ton of documents and thought I need to bring, he said he looked over and everything checks out and he didnt need anything.

 

I uploaded the following as per the app

1. copy of Marriage Cert

2. copy of my GC

3. both kids birth certificate

 

and then unsolicited evidence of last 5 years of tax transcripts (4 from IRS and 1 year of returns).

Timeline

The required evidence for the N400 regardless of 3 yr or 5 yr rule requires proof of your current marital status.  As to the other evidence requested to be brought to the interview, many people upload that as well.

I filed based on the five year rule and only uploaded my green card, marriage certificate and the five years of tax returns (I don't have any kids and no previous marriages).

 

May 25, 2004: Got married in Denmark
June 8, 2004: Received passport with new last name
June 11, 2004: Went to the U.S. embassy in Denmark to file the I-130 and DS-230 - approved on the spot
June 18, 2004: Received letter of appointment plus packet 4
August 5, 2004: Interview at U.S. embassy - APPROVED!!!
August 19, 2004: Went back to the U.S. with my husband
May 27, 2006: Filed I-751
July 25, 2006: I-751 approved!

March 13, 2016: Filed I-90 for Permanent Resident Card renewal

March 22, 2016: Received letter of appointment for biometrics appointment

April 8, 2016: Biometrics appointment

September 21, 2016: I-90 approved

December 27, 2022: Filed N400 for US citizenship

December 27, 2022: Biometrics reused

February 2, 2023: Interview notice received

March 10, 2023: N400 approved 

March 10, 2023: Oath ceremony notice provided right after interview 

March 24: Oath ceremony

My wife filed by paper and she only provided the required evidence (in her case a GC photocopy and our marriage certificate).  She took all interview material with her in a binder folder and the IO did not ask to see any of it.

I'm still waiting for my interview so we'll see if they want to see any documents. 🙂

They wanted to see my marriage and divorce certificate at the interview based on 5 year GC. It's better to be too prepared than not prepared. Good luck
