Hi all

I filed our I-130 online in Nov 2021. I've just received a request for evidence stating:

Quote

USCIS is not able to open and view the evidence you initially uploaded. Therefore, please reupload/resubmit the Form I-130A, Supplemental Infomration for Spouse Beneficiary, your birth certificate or evidence of United States Citizenship (USC), as well as the marriage certificate

(Yes the typo in "Infomration" is in the actual letter... how professional!)

Has anyone seen this before? All my evidence was uploaded as PDF and I have no issue viewing them in my account portal. I'm a bit worried to proceed with online filing now as if they "can't open" my response won't we be automatically rejected?

Are you doing AOS or consular?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

That's consular.

Just redo the application

Right. That is what they requested.

But I'm worried they "Won't be able to open and view" again which will result in a rejection. Right? If the evidence requested reply isn't good you don't get another chance is my understanding.

So should I mail this one in? Upload through the portal again?

Make sure your PDF are unsecured.  Re-print your PDF or save as new PDF.  Watch the size as well. Also, open it via Adobe Reader - other PDF readers have issues with reading immigration forms and vice versa.   Hope this helps!

No, no, no.  Just upload new supporting evidence files.  Each document in its own PDF file.  Use Adobe applications only, no aftermarket programs.  That may be your problem.

Note an I-130 is not an "application" for anything.  It's a petition for alien relative.  They are already on somebody's desk if they have an RFE.  Redoing, would put them back at the beginning of the line.

Can anyone comment on whether or not I should update the information on the I-130 and I-130a?

Since originally filing in 2021 my spouse and I have both moved and taken new jobs. So I'm wondering if I should fill the form out as I would today or exactly as I originally submitted in 2021.

the i-130 petition is about verifying that your spouse is your spouse.   Stuff about job's come at the NVC stage.

The I-130 has questions about my job and residence. Both of which have changed since I filed in 2021.

The I-130a has questions about my wife's job and residence. Both of which have changed since I filed in 2021.

I'm just wondering if I should resubmit the forms exactly as I originally filed or if I should provide the latest information.

As stated.. both I 130 and130a are already on someones desk. They are a “ moment in time” form  which are accurate at the time you sign them .. they are not the subject of the RFE. Send that has been requested by the RFE.. nothing more .. nothing less
