I-765 Question - Previous F-1 holder now a Spouse of USC

Hey VJ! 

 

A couple of questions that I’m hoping someone can help me with!

 

My background (condensed) I was an F-1 visa holder from 2015-2020, with the 2019-2020 year being OPT. So, I have an expired EAD card and a social security card with the “DHS authorisation required” stamp on it. I returned to the U.K. following my education, did long distance through the covid pandemic with my girlfriend (now my Wife, since October 2022). I’m now in the US and we are doing the AOS I-485 - I-130 package. 

 

So, to get to my question: I-765 Part 1 Reason for applying - I chose 1c for a renewal, is this correct? Or should I choose 1a for initial permission to accept employment, as it is completely separate from my F-1 days? 

 

Secondly, Question 14 “Do you want the SSA to issue you a social security card?” I figure no because I already have one, although it does have the “DHS authorisation required” stamp on it. Is this an issue? Should I get a new one hoping that stamp isn’t on there? 

 

Thank you very much. Attempting this without a lawyer is daunting but this website has helped a lot! I look forward to your responses.

1. Initial as this is a NEW petition, under a NEW category. 

2. No

 

Then there should be a question down there asking if you have ever received SSN. Choose it and input your old SSN. SSN are for life. You will not get  anew one. 

Once you get your GC, go back to SSO and remove the DHS wording. You cannot remove it unless you have a GC

just wanted to share my EAD filing last year. my old EAD was under C08 ( asylum) and when i applied for EAD under marriage case C09 i asked the same question to my lawyer, because he choose renewal. everyone on visajourney who commented said its Initial and not renewal. my lawyer said he filed 1,000 EAD case like mine and he choose renewal, never an issue. well i did get the EAD and its not issue with the "renewal". hope it help

Thank you for the advice! I reprinted the page and selected initial :) 

Just to pick your brain more, do you think I need to submit my I-20s to prove my student status back then? So they know that I was employed legally etc? Or does this just over complicate my case and is not needed?
