Few questions following I-485 bundle rejection

Hello,

 

Hope this finds everyone doing well. We recently received a rejection form that I have attached on this post. In light of that - there were a few questions we had:

 

1.       Does the rejection reason have to do exclusively with the outdated I-485 form being used? I ask because it also coincided with our ‘priority date not being established.’   I have seen others post similar notices with the guidance being the priority date portion is related to the wrong form version used. 

2.       With our files being sent back to us, can we substitute the I-485 for the correct version and re-send the other forms like I-131, etc. as they are (staples included)? Or do we need to re-print everything once more?

3.       This is a silly one but for the sake of confirming – are the money orders they sent back still considered unprocessed? Otherwise, do we need to now pay $1,225.00 again to resubmit our package?

i will use the most updated / current form to all of the form that you are going to send next. 

my suggestion, copy everything before you resend the application.

 

if they send back your application, usually they wont take the money order ( unprocessed)

Hi, thanks for the quick follow-up. Will be sure to do as you suggested. Also just thought to check - is the 'priority date' issue in their letter also related to the wrong form or a separate matter?

Did you submit a copy of the I-129F approval notice in your I-485 package?  Not including the I-797 for the K1 I-129F is a common reason for that message about priority date not being established.  Also, make sure that the I-485 section about the underlying petition (part 2, items 3 & 4) is filled out with the correct info from the I-129F I-797.

Hi Chancy, I unfortunately moved addresses and don’t have a copy of the NOA2. I outlined this in the cover page and included a letter from the NVC regarding the embassy interview phase, and the front page of our K1 visa that has an ‘approved stamp’ with the date (guessing this would be our priority date then?). It does seem we did not file the priority date on part two unfortunately. Should we be okay then otherwise? 
 

Also as a final question, assuming the rest of our forms are okay - is it fine to simply remove staples and resend everything again provided in proper order?

Make sure that you use the current edition of the I-485 and other forms.  Along with the latest forms, you may simply resend the rest of the documentary evidence you submitted before.

 

Reminder for the I-485, part 2 -- check item 1a (Family-based, Person admitted to the US as a K1 fiance), and fill out items 3 & 4 with the I-129F receipt number and date.  If you did what you said in your post here from years ago and your packet was not rejected then, your PD is sometime in October 2020.  Hopefully you have a record of the receipt number written somewhere or in your emails or chats --
