3 year rule or 5 year rule?

My partner has finally decided to apply for citizenship.  We have just started the process and looking over the paperwork.   My question is this.  We have been married for 8 years and have lived in the USA since that time.  Will he be applying under the 3 year rule or 5 year rule?  Does it matter which one we use?  Thanks.

5 year rule, but he needs 5 years of tax transcripts.  Generally you can get the last 3 and sometimes 4 from irs,gov.  He can bring all 5 to his interview if he is missing some.
