Hello people.

A question that I know has been asked before.

My understanding is that we have 90 days to submit the AOS.

Does the 90 days start from when the visa was approved, or from when my fiance entered the United States?

She was appoved on Jine 13th, but got here July 19th.

wow, we have already recieved our Biometrics appointments. It is only 2 1/2 weeks away.

It seems to be moving rather quickly.

The 90 day marriage clock starts on entry.. The I-94 has the exact date.... While it is highly recomended that you file AOS within the 90 days, there does not appear to be a hard and fast rule (or at least cause insurmountable problems).

K-1 Visa. The beneficiary has 6 months from date visa is issued to enter the US. Once IN the US, the beneficiary has 90 days to marry the petitioner. Once that has happened, it is best to file AOS as soon as possible because they (the beneficiary) will be considered Out of Status - you'll hear stories of people who have waited a long time to file for AOS, while most do it pretty much immediately (once they have the marriage certificate and/or any other particular documents they need). So, it's not 90-Days to file for AOS, it's 90-Days (from entry date) to get married. :thumbs:

Hi, we filed for AOS february 12th, while my I-94 expired on february 13th.

I did get approved 2 weeks ago.

You don't have tgo file immediately, but it is recommended, since you want the beneficiary to have a legal status as soon as possible, it will help in a lot of situation, but it is not mandatory to do so within those 90 days.

As said you need to get married in that time. :yes:

Keep in mind, too, that AOS fees go up at the end of July (I believe July 30?), so if you can file before then, you could save some money.

Comments : For Casa, packet 3 and 4 come together, with an interview date already scheduled.

AOS Filing date : 2007-02-02

NOA date for I-485 : 2007-02-07

I-485 RFE Dates : 2007-02-16

I-485 Biometrics Appt Date: 2007-02-28

AOS Comments: Strange - we received RFE, then a few days later got email that the response had been received and the case was resumed even though we haven't sent anything yet.

I-485 Sent to CSC 2007-03-12

RFE for Medical Examination mailed 05-31-2007

medical examination sent 06-27-2007

Case resumed on 07-13-2007

email "card production ordered" 07-18-2007

email “notice mailed welcoming the new permanent resident” 07-19-2007

email “approval notice sent” and welcome letter received 07-23-2007

Green card received 07-26-2007

EAD Filed Date: 2007-02-02

EAD NOA Date : 2007-02-07

EAD Biometrics Appointment Date : 2007-02-28

EAD received 04-16-07
