Giving birth in Nigeria after immigrant visa has been granted

Hello everyone. 

My ir1 visa was approved yesterday and i am currently 36weeks pregnant. I checked online and found out that i can't fly because I am almost due. Please will my child need a visa to accompany me after being born? What document is needed for the child after birth?

Your response will go a long way for me...thanks

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The father has to sponsor the child the same way you were sponsored. Double check that you can not file a CRBA

Assuming all  of these are true:

 

* the child will not be born a U.S. citizen,

 

* your visa is in your hands before the child is born 

 

* the visa hasn’t expired when your child has a passport and birth certificate in hand 

 

the child does not need a visa.

(don’t get hung up on the uk part of that url. The law is the same across embassies.)

 

If your child is born after the issuance of your immigrant visa s/he will not need a visa to accompany you provided you both travel within the period of validity of your visa.  You are required to carry a copy of your child’s long-form birth certificate for presentation to an immigration officer at the port of entry, together with a valid travel document for the child.

Please note: If the child’s natural parent is a U.S. citizen, your child could have claim to American citizenship and his/her eligibility for citizenship must be determined before traveling

 

1. When does your visa expire?

 

2. how fast can you get a birth certificate that meets the requirements of https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html for the child’s country of birth?

 

3. how fast can you get a passport for your child after you get the birth certificate?

Child born abroad to an accompanying parent after issuance of an immigrant visa to the parent but before the parent’s initial admission as an immigrant may be boarded as long as the child has a passport and birth certificate.

 

So CBP is not telling  airlines to ask if the child is a U.S. citizen.  And that is all I am going to say.

Is the dad a US citizen?

If YES, when did he obtain citizenship?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

You should worry about it because if your child is born a US citizen, you must get his/her CRBA while you are in Nigeria.
