Unsolicited Evidence

I have already filed the I-130 for my wife's IR1; priority date 22 JUL 2022. Since then some documents and evidence have been created and/or changed.

 

- Marriage Certificate has been Apostilled by The Philippines DFA 

- Our son's Birth Certificate has been Apostilled by The Philippines DFA 

- My son has received his CRBA and US passport.

 

Will filing this in addition to what documents they currently have help the case or should we just wait for the interview and/or NVC to present these documents?

I'm now a believer in unsolicited evidence. I don't understand how this evidence helps your wife's case, assuming you provided your marriage certificate and your son's birth certificate in the original evidence.

 

Perhaps there is something specific to the U.S. embassy in Manilla that makes your proposed evidence useful. If so, that would happen at the consular stage.

USCIS, NVC or US Embassy Manila could care less about apostille for Philippine documents.  They want to see Philippine documents that are certified by PSA.  In fact there was an isolated case a while back where NVC rejected an Philippine apostilled document because they attached the apostille (which is not needed) with a tamper proof round metal eyelet that punctured a hole through the PSA seal (which is needed).  So NVC rejected it.

  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

Apostille is not required by US immigration at any point of the process.  Submitting apostilled versions of documents already submitted with the I-130 would not help your wife's case, nor would they be required by the US consulate in Manila.

I totally get why you think these documents might help, as Philippine organizations just seem to LOVE notarized, gold sealed, stamped, red beribboned and apostilled things (DFA, PH government departments, real estate, banks, hospitals etc.) However, for the purposes of US immigration/visas, I've never had to submit anything notarized or apostilled. Just follow the instructions and make sure to submit the requirements and documents that are needed, in the format that they ask for. If it asks for a copy of something, submit a simple scanned copy- you don't need to have it notarized. If it says PSA copy, submit a PSA printed copy and don't add or do anything extra to the documents.

 

Try to think about the human CO reviewing your documents- if you're the CO, and you see the PSA birth certificate that was asked for, why would another PSA birth certificate but with an extra seal and holes in it be useful? What if during the shuffling of your files, the CO sees the apostilled birth certificate first and seeing as it's not what they asked for, sends you an RFE, adding months to the already long process? This process is so long, with documents going through so many hands and eyes, it won't help you to add things that can confuse or complicate.
