Visiting Wife for Extended Period

Hello everyone!

 

My wife and I got receipt of our I-130 on October 8 2022. We don't want to be apart for how long this might take, so in May I am planning on breaking my lease, putting all my things in storage, and going to Australia for an extended visit (for up to a year). The ideal state is that by the time my visa is up (or before) we can travel back to the US together. I'm planning on "moving in" with my parents and putting their address down as my permanent address while I'm traveling in Australia and updating my address on the I-130 petition likewise. My question is: is this cool? Is there anything I'm not thinking about here that could potentially jeopardize our I-130?

but it may take 2 years not 1

Can u afford to do this/  for your info only / i don't need to know

 

u need US income to support petition at poverty levels and above

u need to file US taxes and have iRS transcripts or W2 and copy of 1040)  or the statement from IRS VNF (nonfiling tax statement)  for NVC 

if no income ,  u need joint sponsor

 

Keep your state ID or DL (but change to parent's residence before u leave

Spouses can get a NIV for a 12 month stay    
Our DIL  used one when the family spent 9 months in Aus. The kids all had US and AUS passports.

As long as you can afford the zero income and not working for 12 months .. and have a joint sponsor lined up for the I864 AOS requirements .. it is fine .. warning .. you might not want to leave Aus after living there !!!

You should be fine.  Just keep your ties to the US - the address at your parent's place, bank accounts, taxes filed, etc.

Thanks for the second set of eyes, y'all! Really just wanted to make sure there wasn't some "gotcha" that I was missing. Money won't be an issue, and I won't require a joint sponsor. I will make sure to keep those ties with the US.
