How long to wait until getting married k1

Hello VJ,

 

My fiance is coming to the US next month with K1. I heard the fees might be going up for AOS. So I wanted to get married fast and apply for AOS, how long should we wait to get married? I'm thinking like a week or so and going to court to get married. I'm in NY and if anyone knows the procedure to get married in NY please let me know.

Forget about the NY court marriage thing. 
 

1. Get a Utah zoom wedding marriage license now (but no sooner than 3 weeks before he arrives as the license is good for 30 days) https://www.utahcounty.gov/dept/clerkaud/PassMarr/RemoteAppearanceFAQ.asp and 

 

2. Two working days after he arrives, go to the social security office to apply for his SSN.  Sone SSA employees will not process SSN applications of the K-1 is married. He must do this while single. 
 

3. get married. 
 

4. the Utah zoom marriage certificate will be emailed to you within 24 hours. Print it. 
 

5. file the I-485 package once you’ve printed the marriage certificate 

 

6. the paper marriage certificate will be mailed to you. Bring it to the I-485 interview 

 

You can have this all done in a week.

Not sure why you’re asking how long you *should* wait?

 

You will have to look up how to get a marriage license for your county.   The county will have that on their website, and it is easy to find, publicly available information.

 

In many places, there is a 3-day waiting period after obtaining the license.   But like I said, please do your own research for your own county.

 

It is recommended that the first thing you do after the fiancé arrives, is go to the social security administration (address also can be found online)  and apply for an SSN, as this becomes problematic after marriage.

I would say get married as soon as possible after your fiance arrives. The sooner you marry, the sooner you can file for AOS

you only have to wait 24 hours after getting license to marry

 

Couples can now apply for a Marriage License in person or online at www.nyc.gov/cupid. In-person Marriage Licenses are issued by appointment only, and couples must arrive on time. Late arrivals may not be admitted.

Also, marriage is a qualifying event for changing employer-based benefits like health insurance, so if you're planning to add your fiancé(e) to your insurance and don't want them to go without insurance for very long that's another reason to marry ASAP.

 

/it's true that a lot of companies allow unmarried domestic partners to get benefits, but that usually takes some paperwork
