Have you seen an application delayed for submitting all relevant documents? Not a friend of a friend… first hand? Have you ever known of an officer saying they delayed the decision because the applicant submitted too many documents?

When filing online, the N-400 specifically directs the filer to add evidence of the marriage.

I didn't cut anything, I pasted the list of evidence of a bona fide marriage. You were previously saying bona fide marriage evidence isn't needed at all and you specifically said the IO doesn't care about leases or bank statements, which is patently false.

 

You are ignoring 2 things:

1) that the online N-400 asks for marriage evidence 

2) that the instructions for the paper N-400 says "you may submit copies" of those documents with the application

 

You also haven't had your N-400 interview yet, but Crazy Cat's wife just had hers in December. And guess what? They added the marriage evidence to the online application.

That checklist you reference is just an abbreviated version of the official instructions.  The actual instructions include submitting more than "required" documents.

Hey y’all again,

today I went to file my taxes and maybe this year (due to some independent income) it might make more sense to file MFS (a bigger refund by the thousands). The CPA will run both scenarios (MFS and MFJ) and will let me know. But if we do end up financially better by filing separately, is that going to be an issue?

And will just a bigger refund be enough of a reason for N400?

Won't be an issue.  Your spouse's SSN will be on the MFS transcript/return.  Choosing the best tax strategy is wise, imo. 

 

Our CPA always runs our number both ways, too.  My wife filed MFS on her first tax return.

Yeah it’s just that due to some independent income we might end up with a bigger Federal refund, which we’ll probably need to pay for city taxes, that are sky high in here. 
But I do wonder if that’s a good enough reason for USCIS (do they even care ?)

Tax strategy is not an immigration issue. USCIS won't care.  As I said, the MFS return will show a clear connection between you and your spouse.   You could include your spouse's tax return/transcript to show same address if needed.

Thank you. If it’s only a few dollars of difference then we are MFJ. But the CPA thinks there might be a bigger difference if we MFS, so we’ll see what he says. I really trust that CPA.

Yes, also tax return transcripts aren't only used for evidence of a bonafide marriage, but also to show good moral character - ie that you are paying your taxes as you should. This is also why USCIS want to see a payment plan with IRS for those who owe backtaxes - it shows good moral, that you are doing what's right. 

 

So yes, definitely upload once the transcript is available. And like Crazy Cat said, you can easily upload both your and your husband's transcripts in case you decide to file separately.
