I751 application - automatic 24 month extension expiring with no USCIS contact/appointment

I submitted my I751 application to remove conditions on my green card in Dec 2020, and received an automatic 24 month extension of the expiration date on my green card.

That 24 month Green Card extension is now almost up - on January 18th, in 8 days. I work for a VA hospital, and need to prove my continued US work eligibility for my employment.

 

I've been calling USCIS for months; last week I heard that my interview request was "escalated" with the local field office. But more than 72h have gone by without further contact. 

 

Is there anything else I can do to get an interview or an additional extension stamp? Should I try to show up there at the USCIS office without an appointment? (this seems like it won't work, but is better than doing nothing)

 

I'm reading online that possibly the validity of my resident status and right to work is different than my green card - and maybe I still maintain this, even if my GC extension lapses. Is this true? Any other ways to prove that I remain a legal resident and able to work?

Yes, you do not lose your LPR status even if your CGC and extension letter are expired.  Only an IJ can remove someone's LPR status.  I would keep trying to get an appointment at your local office, and maybe even try a walk-in.  It is such a pain that USCIS is not more customer friendly especially for its paying customers or a taxpayer, but if another US Department requires you to continue to prove your valid status, maybe you can get past the first gate at your local office and you can get an ADIT/I551 stamp.

When you called USCIS to get an appointment, did you request "infopass" in the automated system?

No. If a worker records a USCIS or Alien Number, or an Admission Number, in Section 1 of the Form I-9, an employer is not allowed to ask or see a specific document with that number or otherwise specify which documentation a worker may present, based on the worker's citizenship status. Asking an employee for proof of citizenship or immigration status in the process of verifying a worker's employment authorization could violate the law that IER enforces at 8 U.S.C. § 1324b(a)(6). During both initial verification and reverification, a worker may choose which documentation to present from the I-9 Form List of Acceptable Documents.

I thought the same thing, but wasn't sure if this applies to a federal agency like the VA/USDVA.

most positions at VA hospitals require a USC 

but under the Title 38 and Hybrid Title 38 health care occupations LPR can work

so,  if they accepted the A number on the I 94,  the person has the same rights about showing the green card (as i see from reading)

Call USCIS. Say infopass, specify it is urgent due to being required for employment proof (it isn’t urgent but they don’t know that) and hopefully that gets you a quicker call back appointment than the joke it has been for some time of 30 days plus for a call back. 
Once that extension letter has expired DO NOT LEAVE THE US until you have got an i-551 stamp in your passport at an infopass appointment. I can’t stress this enough. 

 

As for continuing to work;

1) your right to work does not expire when your 24 month extension does. Your status as a LPR remains the same. 
2) if asked for anything by HR, ignoring the fact that they legally really shouldn’t be (although I personally would push back on that, depends how much time and energy you have to do so) just show them an unrestricted SS card and a valid state ID, which fully complies with and fulfills I-9 requirements for employment purposes as a list B+C document. Nothing else needs to be shown or produced to your employer or discussion entered into.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Hello,

 

My extension letter will be expiring soon as well.

Did I get the process correctly?

I should call LOCAL USCIS and say “infopass” and tell the agent, I need ADIT or I-551 stamp for proof of LPR. 
I have plans of travelling to home country too.

Is ADIT, I-551 suffice for travel and to present for a new employer when I get back?

Please remove my query, if this shouldn’t be o this thread.

Does your SS card have the line "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" or something like that? If yes, go get it changed to a regular SSN, then give it to your employer.

For employer though, unrestricted social security card and valid drivers license is way better proof. Then you won't need to worry about your stamp expiring. You wouldn't even have to mention stamp to them.

Never knew they were lifetime. Mine was good for about 50 years, I still have the old voided one from when I moved to Nevada. Maybe mine was issued after the lifetime, or the 50 year is considered the lifetime one.
