Case outside normal processing times

Hello everyone,

I’m wondering if anyone has any suggestions on what to do when your case is outside normal processing times and USCIS isn’t responding to your service requests.

My wife came to the US on the K1 visa in Oct 2021, we got married in Nov 2021, and we applied for the work permit and green card in December 2021. I was told December 6, 2022 was the date the work permit was officially outside normal processing times so we called USCIS that day and the person that spoke with us submitted a service request and said USCIS would contact us within 30 days with an update. We called yesterday Jan 6, 2023 and they said it had not been a full 30 days and to call back Monday and you can put in another service request then.

They have not given us any reason why it’s taking so long, and I have lost trust/hope the service request will do anything. Does anyone know if there is anything else we can do from here/ have any suggestions to get some kind of response and or approval from USCIS?

I765 and I131 can be processed together.

That's the ideal situation as then you'd get a combo card.

In order for them to do that, you'd need to refrain from placing an ONLINE outside of normal processing times enquiry until the LONGER process was actually outside of normal processing times.

The longer process is I131 right now.

Even if you filed BOTH on Dec 31, 2021, (you didnt mention your Noa1 date and I truly dont check timelines anymore cuz y'all don't care when we ask you to full them out) would not be outside of normal processing times for I131 and ineligible to place an enquiry until the end of this January.

You can input your actual NOA1  received date on the website for I131 and check it out yourself.
