I've heard that pursuing alternate visa types shows "immigrant intent," and may weaken the case for the visa being applied for.

Ya and being married to an American and having an American son and no job also hurts her chances. Slim possibility it will be approved but we don't have another option, fjb. The plan is to explain to the consular officer that she won't try to immigrate because that requires the vax. Whereas just being a tourist doesn't. And we already moved to a 3rd country and got residency house school car etc.

"Although refugees and K visa applicants are not required to receive vaccines before traveling to the United States, they must meet the vaccination requirements when applying for adjustment of status or permanent resident status in the United States."

I bet your chances of getting a waiver in the US are much better than in PH. Plus you get to stay inside the US while waiting for their decision. And you could probably get a lawyer to keep appealing and draw it out forever

My wife just had her SLEC day 1 today.  She says they only requested her municipal vax card.  She said they wanted the proof that contained the vax plus the booster.  She brought the VaxCertPH but they did not use it since the municipal record was more complete.

So, maybe this info, might help determine where to get the required documents.

Many Filipinos don't have shot records.

And sometimes records exist when they previously didn't.

Record keeping isn't like what it is in

I respect the principles.  Was just chatting with my wife... she showed me her original vax card.  Entirely handwritten data.  No id number, just a lot number. (And, yes, she legitimately got the jab.) She uploaded a picture of it to the municipality.  From there, she was able to print the official proof with a QR code.

We were just saying to each other, if we were in a similar situation, we would retry the IR visa, having fixed the problem.  Some principles come before other principles.  No judgment!  God bless you guys!

My thinking was that she would get denied and than we would apply for a 601 waiver and explain that the vax is against her personal beliefs and they would just make her jump through some hoops and than grant the waiver....But they rejected the waiver too!

Well, you might be overthinking it, but I'm just some guy on the internet with an opinion.  🤣

An immigration lawyer could probably give you better, actionable direction and put things into perspective.

Our lawyer said also that i need to get the vaccine for me to fly out US. I just have to do this or else my partner will not be so happy. I prefer to stay here in the philippines he would be the one to relocate here if things would not work out with the visa process.

Just be prepared that st lukes extension will be very unpleasant and that the embassy worker will probably reject your visa at the interview and treat you like you're a bad person who is killing grandma's.
