Timeline

Please I have a question. In January of last year, I filed for an AOS, which was a family-based application. At the time, my son was 20 years old, and he turned 21 this past March. Unfortunately, only his application was denied. My question is, would I be able to file for him when I receive my 2 year green card?

You posted in the AOS from K1 visa forum.  Did you enter the US with a K1 visa?  If not, what visa did you use?

On what basis are you AOSing your son? You don't even have a GC yourself. 

 

Is your son in US right now or Nigeria?

When did you:

1. Come in on B-2?

2. Marry?

3. Are you married to a US citizen?

 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

My husband filed family based and he added him to the application. But he was over 18 year old when we got married.

You came on B-2. He cannot adjust. 

File for him when you get GC. However, he has to leave the country to avoid a ban as it'll take roughly 7 years. He cannot stay and wait on the petition

What was the reason of the denial?

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I think I did. I just joined this site today. I'm learning how to respond back.

I came in with my kids 2016. I was married to my ex husband 2017 but because of his physical abuse and infidelity, I couldn't continue with him and the application he submitted for us was denied. 

I remarried Oct, 2020 to present husband who is a US citizen. But my son was already 20 before I remarried. Hope I answered your questions.
