I don’t think she’s ready to be married yet hence finding all these phantom excuses about bans and fraud not to get married immediately. That’s the bottom line.

Good luck!

Just another random guy from the internet with an opinion, although usually backed by data!

So both via paper? Thank you!

If you file them all together, it has to be by paper because the others  cannot be filed online.

Do I? I still have my job, I’m just temporarily out due to the injury. Thank you!

I'm worried it would be denied/thought to be fraud because of the situation. Our premise for marrying and doing AOS from here is the accident and the fact that I need help at home. What if the immigration officer handling AOS thinks that my accident wasn't serious enough to need help? Or what if they ask why someone else couldn't help me, why did he have to stay and do it?

I think I'm overthinking this but I'm just so worried something will go wrong. I hope I don't sound argumentative, its not that at all. I'm just afraid haha. Thank you so much for all this help!

Unlike many who adjust from VWP/B, your circumstances truly did change.   I would marry and file the AOS//EAD/AP documents straight away, along with an expedite request for the EAD since you are unable to work.

Hopefully you have a joint sponsor lined up.   Best luck.

OP is still employed, on sick leave.

So you are not being paid by your Employer, when do you expect to be back at work?

No, through insurance. Does it matter where the money comes from? No clue on the return date just yet, depends on how surgery goes. My ortho team says maybe as soon as 12 weeks if I heal well.

The income will matter at the interview stage right? So I’ve got time to figure this out? I’m assuming it’ll be 6-12 months for the AOS interview with the way things have been going.

Thanks again!

You mentioned AFLAC.

Normally you would send in pay slips with the I 864 but you will not have any, well if this is recent maybe you do.

Yes, Aflac is my disability insurance company that is covering my salary during this issue. I’m a salaried employee so I get paid once a month. The accident happened just a little while ago so I got a December paycheck pretty close to normal.

I would go with those.

No, if he is adjusting status, you will be sending the I-864 with all supporting documents with the I-485.
