The B visa is not a good avenue to go and I would reconsider even doing it at all because he’ll lose his Esta if the B visa gets denied. The reason for applying + having a spouse and child in the US=

Hi everyone! I have one more (maybe stupid) question.

 

Paperwork was sent off and we have all the NOA1s. My husband obviously has nothing to do besides be in the house with our toddler since he can't work. We enrolled him in two classes at the local community college for some intellectual stimulation and adult conversation. Was this a bad idea? My lawyer friends are saying that now it really looks like we misrepresented the ESTA if he's "settling in" so quickly. BS or genuine concern? Drop out of school?

Ask the attorney how many cases have been denied due to "settling in so quickly".  The answer will be zero.  Ignore him and move forward with your lives together.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If they are not bothered about working illegally why would the be bothered about a couple of classes.

I think it's a great idea to have him take some classes! It's a long wait, so anything he can do to stay busy is awesome! I don't think it looks like he is settling in too quickly; it just looks like he is accepting his fate and trying to find a way to get through the long wait without losing his sanity!

If anyone is curious about updates, my husband got his EAD in 29 days!!

 

4 January 2023 - filed the I-130, I-131, I-485 and I-785
5 January 2023 - NOA1 for all four
14 January 2023 - notified that biometrics was scheduled
18 January 2023 - got biometrics notice in the mail, appointment scheduled for 3 February
3 February 2023 - biometrics
3 February 2023 - I-485 status updated to “actively being reviewed”
3 February 2023 - EAD actively being "actively reviewed," then approved!

Wow, that was super fast! Congratulations!

 

USCIS seems to be following the ‘last in, first out’ principle now because many new cases seem to get processed really quickly now, while older cases just keep sitting idle. I hope this doesn’t encourage (even more) people to just adjust status from non-immigrant visas, because it is starting to look like it is worth doing that instead of filing for an immigrant visa now!

USCIS needs to clean up their act!

I've noticed that too. A lot of people who filed November-January got it in 1-2 months and those who filed a year ago are still waiting. 😕

Thank you! I really appreciate it! We were actually considering expediting EAD because I'm still out of work for 6+ more weeks. Very grateful!
