B2 to help US citizen after surgery

Timeline

We’re headed to town hall tomorrow to get the marriage license. We can get married same day, no problem. But the justice of the peace we found to marry us tomorrow is saying it can take several weeks to get the actual marriage certificate in the mail. 
 

This is obviously a problem right? I need to file everything before the 90 days are up? We’re going to ask the JotP to physically drop off our paperwork instead of mailing it to save time. And we’re going to try to go to vital records a few days later to request a copy instead of waiting for the certificate in the mail.

Ask for a certified copy of marriage certificate. They can give it to you, right there for like $5. I would get 2 or 3. A friend did that and used it to file his papers. Had no problem with USCIS. USCIS accepts certified copies of marriage certificate. It's in their guides. Anyway, problem solved. 

 

Now, for I-864, you only need your IRS transcripts of 2021, 2020 and 2019.

I have plenty of tax transcripts, no worries there! I just obviously won’t have 2022. 
 

You guys are so amazing, I appreciate you so much. Thank you for making something positive out of this nightmare for us.

He can not work now, on a K1 he would have same issue

EADs seem to be coming though quicker so fingers crossed

Understood. Yes, they seem to be coming quicker at least in the last few months.

We aren’t too worried about the EAD. We knew when we applied for the K1 that it would be a while anyway. The original plan (with the K1) was for my partner to be a stay at home dad anyway. We pay just over $2,000 a month for daycare where we live. Saving that is just as good! His take home pay after taxes would barely be better than that anyway!

If he has the documents needed to marry as a birth certificate,  then marry and send ALL forms to adjust (as listed in the guides above)

 

and keep the elevated above the elbow /that's how i got thru it

Well, we got married this morning! At 9am in town hall, wearing my sweatpants and my cast. 🤣 We didn’t take photos and I already regret it. It would have been a great story for the kids. 

 

Got the certified copy right away, so now it’s time for all this paperwork. Thank you all again!

Congratulations!  Take photos while it is still your wedding day.  No need for anything fancy, even selfies at home will do.  Just something to commemorate the occasion.  The interviewing officer might ask to see photos at your husband's AOS interview.

We are getting the mountains of paperwork done now. Should I add a letter explaining why we are adjusting status from the US? And give all my medical records? Or save that for the interview?

No need for an explanation letter or your medical records.  Not now or at the interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
