Unlike many who adjust from VWP/B, your circumstances truly did change.   I would marry and file the AOS//EAD/AP documents straight away, along with an expedite request for the EAD since you are unable to work.

No, through insurance. Does it matter where the money comes from? No clue on the return date just yet, depends on how surgery goes. My ortho team says maybe as soon as 12 weeks if I heal well. 
 

The income will matter at the interview stage right? So I’ve got time to figure this out? I’m assuming it’ll be 6-12 months for the AOS interview with the way things have been going.

Normally you would send in pay slips with the I 864 but you will not have any, well if this is recent maybe you do.

Yes, Aflac is my disability insurance company that is covering my salary during this issue. I’m a salaried employee so I get paid once a month. The accident happened just a little while ago so I got a December paycheck pretty close to normal.

No, if he is adjusting status, you will be sending the I-864 with all supporting documents with the I-485.

Just to chime in (I haven’t read all the comments yet) once you submit your paperwork your husband will not be able to work, even remotely.
