People have been telling my husband that our marriage is not yet legal  recognised in America until I get there or have my green card.  They said it does not matter if we had filed and waiting for interview, my husband can go and collect marriage licence to marry someone else and he will give it.

Honestly, I would not take any further advice from whomever told you that. At least any advice related to immigration. "They" were hilariously wrong on that theory. If you truly think about what they were suggesting, it actually sounds crazy.

I wasn't really thinking into it but my husband. He is a black American and I am a Nigerian, he believes his people are right.

No matter what he believes, your marriage is "recognized" but it is not a matter of any public record in the USA.  He COULD marry somebody else but it would be a crime.  This is true for all Americans as there is no national registry of marriages or other preventive measures.

 

Either way YOU TWO are legally and lawfully married, so you are "married" EVERYWHERE.

 

Maybe more important is WHY either of you care about this NOW.  What's the issue?

I think because of the long waiting and he is being frustrated and tired. Going to 3 years wedding anniversary in February. Our filing date is since november 2020.

I fail to see how that is relevant to the legality of your marriage.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And so he is considering giving up on your process, and moving on with a new wife, without bothering to get a divorce?  While it is possible to get away with something like that, it is still a crime.  Sounds like it's messing with more than HIS head.
