My brother was raised in USA but was thrown into Mexico and his entire family is in USA including all his children and his dying son. His son was given 3 months to live and we are trying to get my brother down to USA ASAP! We already paid lawyers to work on his case that has been sent to immigration but we need this expedited. My nephew has all his doctors and medical here in USA and he is a US citizen so he can't go to Mexico because it will only speed up his death. My brother has other little ones waiting for his return back to USA but we need this to go faster. His 10 years are already up and he has spent them in Mexico and is doing everything according to law. My parents tried to get him papers the right way from the start but my brother was denied as a kid do to someone saying he might possibly have tuberculosis. He needs to be here with his family especially his dying son. We just found out his son only has 3 months to live. This is an emergency please help!

You have posted this in the Tourist Visa section so I take it he has applied for a Tourist Visa and sought an Emergency Appointment? They can be pretty quick.

Why are the Lawyers not handling this?

I am new on this forum so I wasn't aware that I had posted in tourist area. I don't know what kind of visa the lawyers put in for him but he needs it expedited. I am just trying to figure out how to get it expedited.

You need to talk to the lawyers about it. We can't help you if you don't even know what visa he applied for and probably also don't know at which stage he is.

There are ways to expedite but to be able to help you we would need more information.

Isn't TB curable? So, he should have had this taken care of years ago?

Who pulled for his paper? Parents or one of his children?

Well, if expedite doesn't work, you may as well settle at the border where the son crosses and comes back.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Your brother can try to get to a POE and ask CBP for Humanitarian Parole for a limited duration .
Link below will give contact number for the POE.
At times this is granted and it’s worth the effort. He puts together the Doctors letter that describes child’s grave condition and short life expectancy, birth certificate for the child, if he has a non antecedentes penale clearance .

Understand that this is not to expedite his ongoing immigrant visa case ( that the attorneys are representing him on) , it is a way for him to ask to be near child for a short period.

I will assume here, he was deported , has spent 10 years outside and has a US Citizen wife who has filed an I-130 spousal plus hardship  waivers .. The Petitioner wife ( am guessing here) can get on the phone w USCIS and request expedite based on these circumstances  WITHOUT waiting for the Lawyers to get to it. She can also contact her Congressman and ask for help with expediting his case.

U.S. Customs and Border Protection (CBP) can also issue humanitarian parole (at the discretion of the Port Director) if the requesting foreign national is at a U.S. Port of Entry. Please contact the specific port of entry where you plan to request humanitarian parole to get information about the process and what is needed to make the request.
