Ok, after reading these posts I'm freaking out. My hubby's exp. date is Nov. 1st so does that mean that we're going to have to pay the new fee since the 90 days doesn't start till August 3rd?? If so, would the post office postmark the letter on the 29th and then let me wait to mail it on Aug 1st so it doesn't get there too early?? Ugh! I can't afford to pay any more than the $275 we were planning on...we're closing on our first house in a couple weeks.

Sorry to have to tell you this, but the USCIS determines the fee by the GC date, not the postmark. :( They will look at the GC date and if the 90 days is after July 31, they will expect the rate increase. If the amount is incorrect, they will return the file and request the new fee.

REMOVING CONDITIONS

6/30/07 - Mailed I-751 via Priority Mail with Delivery notification

7/02/07 - Delivered to USCIS in Laguna Niguel,CA

7/07/07 - CSC returns I-751 packet because we used an older I-751 version. Mailed I-751 with latest(02/07) version via Priority Mail with delivery notification

7/09/07 - Deliverd to USCIS

7/10/07 - NOA date

7/12/07 - USCIS cashes check

7/21/07 - NOA received(GC extended for one year)

7/24/07 - Biometrics notice received

8/10/07 - Biometrics appointment in W. LA

8/28/07 - Card production ordered

8/29/07 - Approval notice received online

8/30/07 - Approval notice recieved in mail

9/04/07 - 10 yr GC received in mail

Yes USCIS will reject anything sent to them before the 90 days.

And NO the post office wont do that, besides, good luck visiting the post office on the 29th, they will be closed that day due to the fact that the 29th is a Sunday.

Also keep in mind, it is not a requirement to file exactly 90 days before expiration, why not file in October? That way you have a couple extra months to save up the additional funds.

you can file anytime between the 90 days and the day your card expires...

Accoring to the USCIS it says that you have to pay the new fee if your letter is postmarked before 29th then you should be ok

New Application and Petition Fees Go Into Effect on July 30, 2007

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) reminds its customers that the agency’s new fee schedule is effective on July 30, 2007. Applications or petitions postmarked or otherwise filed on or after that date must include the new fee.

SO you could send this a little slower mail rather than Express or Priority that would get your package before August 3rd. Just a thought!!

03 Oct 05 green card and SSN arrive YEah!!!!!!!

13 Jul Start preparing I-751 packet

21 Jul Mailed Packet to Nebraska!! (Via Express Mail)

23 Jul Packet received @ Nebraska

7 Aug received Packet back as had sent photocopy of I-751

8 Aug Sent back I-751 with original form and all other evidence

13 Sept Received NOA1

26 Oct Biometrics appointment 11/21 Seattle

21 Nov Had Biometrics appointment at Seattle

13 Dec Received notification that greencard has been ordered!!!!
