please tell your wife to not get so upset. This has happened many time to many people and this is not the end of the world.

Her status is and will remain the same - Lawful Permanent Resident (LPR). She’s just waiting for the evidence of that to come through. File I-90 with a fee waived and get the stamp. If it expires, get another one. I-551 stamps ARE evidence of LPR status while she waits for the plastic card.

okay... yeah im trying to get her to relax. she is losing it.

thanks for the insights. she would technically need 2-3 stamps given how long it takes to arrive. hopefully will workout. will update this thread as any new developments arise

its still frustrating.

I understand and it truly sucks that you have to go through this…. I can go on and on about how USCIS has to improve drastically but getting so upset won’t do her good either. It’ll be okay

Recently a forum member shared she received her new GC some 6-7 days after filing the I-90.

You could be as lucky as her.

If anyone knows HOW to write a successful i-90 submission in this scenario please point me in the right direction (resources/links/threads).

I am thinking of adding in the Section 216 clause which states:

"Conversely, if the alien is not subject to the provisions of section 216 of the Act, but the visa classification endorsed on the immigrant visa indicates that the alien is subject thereto (e.g., if the second anniversary of the marriage upon which the immigrant visa is based occurred after the issuance of the visa and prior to the alien's application for admission) the endorsement on the visa shall be corrected and the alien shall be admitted as a lawful permanent resident without conditions, if otherwise admissible."

Also look into the thread below. You can request the ADIT stamp (I-551) to be mailed to your address.

What you need to include is:

1. GC with wrong classification

2. Copy of marriage certificate highlighting date

3. Copy of the stamp on your wife's passport showing she entered on or after your 2nd anniversary

4. A letter explaining you mistakenly received a conditional GC

None of us know what we'd do without it.  There's strength in numbers and accumulated knowledge.  :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello all, It's been a dreadful day.

My wife has the option to:

a. Correct CR-1 to IR-1 and file i-90 form. Takes up to 20 months or longer.

b. Do the i-751 interview.

we have been trying to weigh the pros and cons of each option. She's very paranoid about ICE so she's leaning towards doing the interview. She's been talking with ChatGPT and getting all sorts of wacko answers. So thought I would ask for the community's experience here.

Provide date of arrival to the US and date of marriage.

If this is USCIS error, there’s absolutely no reason to do I-751.

Arrived on Dec 28th, 2022.

Married on Dec 26th, 2020.

My wife had a pretty abusive experience with ICE in the past from overstaying her visa waiver program when she was just visiting here from Europe. They detained for several months. She prefers to do an interview for 751 than risk of being detained or questioned.
