At what point in the process do you file the I130 for the child of K3? Initially you are only required to file the I130 for the Spouse to be eligible to start the K3/K4 process, but if I130 timelines are moving quickly, when would you file the I130 for the child, and would it be attached to the Spouse's I130 so that they hit the Embassy at the same time? Confused? :unsure: So am I!

If anyone is interested, I found the answer to my question............

"If a Form I-130 has not been completed for each of the K-4 children, the children must file a Form I-130 concurrently with their Form I-485." as quoted by Greg Siskind at Visa Law http://www.visalaw.com/05oct2/2oct205.html

What I did was the following: I-130 for Spouse and I-130 for Stepdaughter and one form I-129F adding my Stepdaughter's name on the form. Once I-129F is approved (hopefully this week) they go to get their K-3 and K-4 visas.

What I did was the following: I-130 for Spouse and I-130 for Stepdaughter and one form I-129F adding my Stepdaughter's name on the form. Once I-129F is approved (hopefully this week) they go to get their K-3 and K-4 visas.

Frank, we opted not to do the I-130 for the child, because as you say she derrived K4 status on the back of my K3. But I knew the I-130 would have to be filed at some point, just didn't remember when. We have to do it at AOS.........we have always planned to stick with the K3/4 route.

This should have been posted in the USC forum, but I doubt it makes much difference.

I hope we both have good news this week..........it's getting pretty desperate.
